The 35-year-old teacher Bernadette Smith told the court that her marriage had broken down and she was had sex with the schoolboy Gary Ralston.<\/h1>\n

A married teacher has been spared jail after admitting having sex with a boy of 16.<\/p>\n

Shamed history teacher, Bernadette Smith, admitted abusing her position of trust by \u201cengaging in sexual activity\u201d with 16-year-old schoolboy Gary Ralston.<\/p>\n

The 35-year-old – who underwent a barrage of psychiatric tests before the hearing – was sentenced to a two-year-community payback order and placed on the sex offenders\u2019 register for the same period of time.<\/p>\n

She looked surprised as the sheriff decided not to jail her and left Stirling Sheriff Court with a broad grin across her face.<\/p>\n

last November how mother-of-three Smith, from Denny, Stirlingshire, groomed Gary in her classroom at Bannockburn High School, after calling him in for a lunchtime chat.<\/p>\n

She told the stunned boy she loved him before the pair went to a nearby park and had their first kiss.<\/p>\n

However, the teenager\u2019s grandmother found out and told the school. Smith was then suspended on September 19.<\/p>\n

But just hours after the meeting she visited the house the boy shared with Richard and the pair spent the night together in bed when she stripped down to her jeans and bra.<\/p>\n

Bernadette Smith later told police and colleagues she was in love with the baby-faced student.<\/p>\n

She admitted she knew of the problems in his family life and described him as a caring boy who found it difficult to trust people.<\/p>\n

Gary, who waived his anonymity to talk to the Daily Record, described how Smith first called him in for a lunchtime chat.<\/p>\n

He said: \u201cI thought she was meeting me to ask me how I was getting on and if I had any problems.<\/p>\n

\u201cShe was sitting very close and I can remember blushing a bit. Then she came out with it. She said she had feelings for me.<\/p>\n

\u201cI didn\u2019t have a clue what to do.<\/p>\n

\u201cIt was the last thing I expected and I couldn\u2019t get my head around it. I was stunned. I knew what she was doing was wrong.\u201d<\/p>\n

Gary Ralston, who looks far younger than his years, said Smith then took him to a playpark, where she kissed him and left lovebites on his neck.<\/p>\n

He added: \u201cWhat she did was wrong. If I was in her husband\u2019s position I wouldn\u2019t be happy. I just wish none of this ever happened, and that I\u2019d said no.\u201d<\/p>\n

Passing sentence, Sheriff Wyllie Robertson, said: \u201cThis is a very serious abuse of trust encompassing a range of offending under this act but the offence to which you have admitted is at the lower end of that list.<\/p>\n

\u201cSome may say that had it not been detected it would have led on to something more serious but that is speculation and the psychiatric report suggest that may not have happened.<\/p>\n

\u201cIt is very serious when a teacher acts this way. We expect our teachers to care for their children and protect them from abuse.<\/p>\n

\u201cThe difficulties of your own marriage may have contributed to your actions but other teachers go through the same difficulties and do not commit such crimes.<\/p>\n

\u201cYou have lost your job, your career and your marriage and you have caused distress to your family.<\/p>\n

\u201cThe intense media attention has meant that your humiliation is complete.<\/p>\n

\u201cI take into consideration that you have accepted full responisbility and that the sexual activity was limited.<\/p>\n

\u201cThere doesn\u2019t appear to be any long standing adverse impact on the victim and the further risk of you offending is low \u2013 only two of 17 risk factors have been identified by the psychologists.<\/p>\n

\u201cA prison sentence in this case is not necessary however it wouldn\u2019t have taken your conduct to go much further for a prison sentence to be awarded.\u201d<\/p>\n

Smith\u2019s solicitor Andrew Gibb, of the Educational Institute of Scotland teaching union, told the court that it had \u201cdevastating consequences on her career\u201d and that Smith would \u201cnever resume teaching.\u201d<\/p>\n

He added: \u201cShe regrets this ever happened and tends her apology to the court. She fully realises the consequences to her, her career and her family are great.\u201d<\/p>\n

The court also heard how Smith is due to stand trial later this year for failing to comply with the notification details of the Sex Offenders\u2019 Register.<\/p>\n

She is alleged to have attended a police station more than three days after being placed on the register \u2013 a claim she denies.<\/p>\n

Smith is temporarily suspended from the General Teaching Council and will not oppose the council removing her name from the teaching register at a hearing in the next few months.<\/p>\nError, group does not exist! Check your syntax! (ID: 13)<\/span>\n
