Bu kural bir y\u0131ldan daha uzun s\u00fcreli kira s\u00f6zle\u015fmelerinde de uygulanacak (Bor\u00e7lar Kanunu, Md.344).<\/p>\n<p>\u00d6rne\u011fin, kira s\u00f6zle\u015fmesi Temmuz 2012 ay\u0131nda dolmu\u015fsa, y\u0131ll\u0131k kira art\u0131\u015f\u0131; Temmuz ay\u0131nda a\u00e7\u0131klanan, son bir y\u0131ll\u0131k d\u00f6nemde \u00dcFE\u2019de ortaya \u00e7\u0131kan art\u0131\u015f oran\u0131na g\u00f6re belirlenecek.<\/p>\n<p>BE\u015e YILIN DOLMASI<\/p>\n<p>Be\u015f y\u0131ldan uzun s\u00fcreli veya be\u015f y\u0131ldan sonra yenilenen kira s\u00f6zle\u015fmelerinde ve bundan sonraki her be\u015f y\u0131l\u0131n sonunda, yeni kira y\u0131l\u0131nda uygulanacak kira bedeli konusunda, taraflar kendi aralar\u0131nda anla\u015famazlarsa, mahkemeye ba\u015fvurup \u201ckira tespiti\u201d talebinde bulunacaklar.<\/p>\n<p>Bu gibi durumlarda hakim; \u00dcFE\u2019deki art\u0131\u015f oran\u0131, kiralanan evin durumu ve emsal kira bedellerini g\u00f6z \u00f6n\u00fcne almak suretiyle, kira tutar\u0131n\u0131 belirleyebilecek (Md.344\/3).<\/p>\n<p>\u0130\u015eYER\u0130NE YOK<\/p>\n<p>\u0130\u015fyeri kiralamalar\u0131nda, \u00dcFE\u2019ye g\u00f6re kira art\u0131\u015f oran\u0131n\u0131n belirlenmesi zorunlu de\u011fil.<\/p>\n<p>\u0130\u015fyeri kiralar\u0131nda \u00dcFE uygulamas\u0131, 2020 y\u0131l\u0131na kadar ertelendi.<\/p>\n<p>DEPOZ\u0130TO<\/p>\n<p>Ev sahiplerinin kirac\u0131lardan talep edebilecekleri \u201cdepozito\u201d tutar\u0131, \u00fc\u00e7 ayl\u0131k kira tutar\u0131n\u0131 a\u015famayacak.<\/p>\n<p>Bu para, \u201ckirac\u0131 taraf\u0131ndan\u201d vadeli mevduat olarak bankaya yat\u0131r\u0131lacak. Ancak, kiraya verenin onay\u0131 olmaks\u0131z\u0131n, kirac\u0131 bu paray\u0131 \u00e7ekemeyecek.<\/p>\n<p>D\u0130\u011eER HUSUSLAR<\/p>\n<p>Kiraya verilen evle ilgili zorunlu sigorta, vergi ve benzeri y\u00fck\u00fcml\u00fcl\u00fckler, aksi kararla\u015ft\u0131r\u0131lmam\u0131\u015f ve yasada \u00f6ng\u00f6r\u00fclmemi\u015f ise ev sahibi taraf\u0131ndan kar\u015f\u0131lanacak (Md.302).<\/p>\n<p>S\u00f6zle\u015fmede kira bedeli yabanc\u0131 para cinsinden belirlenmi\u015fse, \u201cbe\u015f y\u0131l ge\u00e7medik\u00e7e\u201d kira bedelinde de\u011fi\u015fiklik yap\u0131lamayacak.<\/p>\n<p>Kiraya veren, ihtiya\u00e7 nedeniyle gayrimenkul\u00fcn bo\u015falt\u0131lmas\u0131n\u0131 sa\u011flad\u0131\u011f\u0131nda, \u201chakl\u0131 sebep\u201d olmaks\u0131z\u0131n, o gayrimenkul\u00fc \u201c\u00fc\u00e7 y\u0131l ge\u00e7medik\u00e7e\u201d eski kirac\u0131s\u0131ndan ba\u015fkas\u0131na kiralayamaz.<\/p>\n<p>Bu hakk\u0131n, kiraya verenin yapaca\u011f\u0131 yaz\u0131l\u0131 bildirimi izleyen \u201cbir ay i\u00e7inde\u201d kullan\u0131lmas\u0131 gerekir.<\/p>\n<p>Kiraya veren; bu h\u00fck\u00fcmlere ayk\u0131r\u0131 davrand\u0131\u011f\u0131 takdirde, eski kirac\u0131s\u0131na son kira y\u0131l\u0131nda \u00f6denmi\u015f olan bir y\u0131ll\u0131k kira bedelinden az olmamak \u00fczere, \u201ctazminat\u201d \u00f6demekle y\u00fck\u00fcml\u00fc olacak (Md.355).<\/p>\n<span style=\"font-weight: bold; color: #f00;\">Error, group does not exist!
