A\u011f\u0131r Ceza Mahkemesi, Bar\u0131\u015f ve Demokrasi Partisi (BDP) \u0130stanbul Milletvekili Sebahat Tuncel&#8217;in &#8221;su\u00e7u ve su\u00e7luyu \u00f6vd\u00fc\u011f\u00fc&#8221; iddias\u0131yla yarg\u0131land\u0131\u011f\u0131 davada, ifadesinin al\u0131nmas\u0131 i\u00e7in &#8221;g\u00fcns\u00fcz olarak zorla haz\u0131r edilmesine&#8221; karar verdi.<\/strong><\/p>\n<p>Duru\u015fmaya, tutuksuz san\u0131klar Meryem Demir ve Hacer Karaka\u015f ile baz\u0131 san\u0131k avukatlar\u0131 kat\u0131ld\u0131.<strong><\/strong><\/p>\n<p>Cumhuriyet Savc\u0131s\u0131 Kubilay Ta\u015ftan savunmas\u0131 al\u0131namayan Tuncel&#8217;in savunmas\u0131n\u0131n al\u0131nabilmesi i\u00e7in &#8221;g\u00fcns\u00fcz olarak zorla haz\u0131r edilmesini&#8221; istedi.<\/p>\n<p>Tuncel&#8217;in avukat\u0131 Mehmet Nuri \u00d6zmen, m\u00fcvekkili hakk\u0131ndaki zorla getirilme m\u00fczekkeresine &#8221;g\u00fcns\u00fcz&#8221; ifadesinin konulmamas\u0131n\u0131 talep ederek, &#8221;Bu durum spek\u00fclasyonlara yol a\u00e7\u0131yor. &#8216;Duru\u015fma g\u00fcn\u00fcnde haz\u0131r bulundurulmas\u0131&#8217; diye yaz\u0131l\u0131rsa daha iyi olur&#8221; dedi.<\/p>\n<p>Mahkeme heyeti, Tuncel hakk\u0131ndaki iddianamenin i\u00e7eri\u011fi, Yarg\u0131tay 9. Ceza Dairesi&#8217;nin konuyla ilgili i\u00e7tihatlar\u0131, usulen yap\u0131lan tebli\u011fe ra\u011fmen duru\u015fmaya gelmemesi, g\u00f6revi nedeniyle s\u0131k s\u0131k adresinden ayr\u0131lmas\u0131, il d\u0131\u015f\u0131nda olmas\u0131, bu sebeple belirli bir g\u00fcnde haz\u0131r edilememesi ihtimalini de dikkate alarak CMK&#8217;n\u0131n 146. ve 199. maddeleri uyar\u0131nca savunmas\u0131n\u0131n al\u0131nmas\u0131 i\u00e7in &#8221;g\u00fcns\u00fcz olarak zorla haz\u0131r edilmesi&#8221; konusunda Cumhuriyet Ba\u015fsavc\u0131vekilli\u011fine m\u00fczekkere yaz\u0131lmas\u0131na karar verdi.<\/p>\n<p>Duru\u015fma bir ba\u015fka g\u00fcne b\u0131rak\u0131ld\u0131.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Ankara 11.
