Hukuk Dairesi, yerel mahkemenin karar\u0131n\u0131 oybirli\u011fiyle bozdu.<br \/>\nDaire&#8217;nin karar\u0131nda, taraflar\u0131n anla\u015fmalar\u0131 \u00fczerine T\u00fcrk Medeni Kanunu&#8217;nun ilgili maddesi gere\u011fince bo\u015fanmalar\u0131na karar verildi\u011fi ve bo\u015fanma karar\u0131n\u0131n kesinle\u015fti\u011fi hat\u0131rlat\u0131ld\u0131.<\/p>\n<p>Bo\u015fanma karar\u0131 taraflar\u0131n anla\u015fmas\u0131na dayand\u0131\u011f\u0131na g\u00f6re, davac\u0131n\u0131n bo\u015fanmadan sonra bo\u015fanma sebebiyle art\u0131k manevi tazminat talep etmesinin m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 vurgulanan kararda, &#8221;\u00c7\u00fcnk\u00fc b\u00f6yle bir durumda taraflar\u0131n bo\u015fanman\u0131n mali sonu\u00e7lar\u0131na ili\u015fkin aralar\u0131ndaki ihtilaf\u0131 nihai olarak \u00e7\u00f6zd\u00fckleri ve ili\u015fkilerin tasfiye ettikleri kabul edilir. Bu itibarla anla\u015fmal\u0131 bo\u015fanmadan sonra art\u0131k bo\u015fanma sebebiyle tazminat istenemez.
