Feyzio\u011flu, G\u00fcl, Erdo\u011fan ve K\u0131l\u0131\u00e7daro\u011flu&#8217;nun da kat\u0131ld\u0131\u011f\u0131 t\u00f6rende &#8216;Milli irade diyenler otoriterle\u015fti&#8217; dedi.<\/h1>\n<p>Cumhurba\u015fkan\u0131 Abdullah G\u00fcl, TBMM Ba\u015fkan\u0131 Cemil \u00c7i\u00e7ek, Ba\u015fbakan Recep Tayyip Erdo\u011fan, CHP Genel Ba\u015fkan\u0131 Kemal K\u0131l\u0131\u00e7daro\u011flu ve Adalet Bakan\u0131 Sadullah Ergin\u2019in de kat\u0131ld\u0131\u011f\u0131 a\u00e7\u0131l\u0131\u015f t\u00f6reninde konu\u015fan TBB Ba\u015fkan\u0131 Metin Feyzio\u011flu, T\u00fcrkiye g\u00fcndemine dair \u00e7ok say\u0131da konuda sert ele\u015ftirilerde bulundu.\u00a0\u2018Milli irade\u2019 tabiriyle ilgili konu\u015fan Feyzio\u011flu, \u201cD\u00fcnya ve T\u00fcrkiye tarihine bak\u0131ld\u0131\u011f\u0131nda, milli irade tabiri daha ziyade, se\u00e7imle i\u015f ba\u015f\u0131na gelmi\u015f ancak \u00e7o\u011fulculuk yerine \u00e7o\u011funluk\u00e7ulu\u011fu benimsemi\u015f ve giderek otoriter e\u011filimler sergilemeye ba\u015flam\u0131\u015f siyasi iktidarlar\u0131n tercihi olmu\u015ftur\u201d dedi.<\/p>\n<p>\u00c7a\u011fda\u015f demokrasilerin \u00e7o\u011fulcu oldu\u011funu vurgulayan Feyzio\u011flu, \u201cmilli irade tabiri, \u00e7o\u011funlu\u011fun az\u0131nl\u0131\u011fa tahakk\u00fcm etti\u011fi, siyasi iktidar\u0131n her kurumu ele ge\u00e7irdi\u011fi ve ya\u015fam\u0131n her alan\u0131n\u0131 d\u00fczenlemeye soyundu\u011fu, insanlar\u0131n ya\u015fam bi\u00e7imine m\u00fcdahale etti\u011fi d\u00f6nemlerdeki i\u00e7eri\u011finden elbette ki farkl\u0131 anla\u015f\u0131lmak zorundad\u0131r\u201d diye konu\u015ftu.<\/p>\n<h2>Metin Feyzio\u011flu&#8217;nun Adli Y\u0131l a\u00e7\u0131l\u0131\u015f t\u00f6reninde yapt\u0131\u011f\u0131 konu\u015fman\u0131n tamam\u0131;<\/h2>\n<p>Ge\u00e7ti\u011fimiz d\u00f6nemde ba\u015fta g\u00f6revleri ba\u015f\u0131nda \u015fehit edilenler olmak \u00fczere aram\u0131zdan ayr\u0131lan avukat, h\u00e2kim, savc\u0131 meslekta\u015flar\u0131m\u0131za, emniyet ve ordu mensuplar\u0131na Allah&#8217;tan rahmet, yaralananlara acil \u015fifalar, bask\u0131ya u\u011frayanlara direnme g\u00fcc\u00fc diliyorum.<\/p>\n<p>Gen\u00e7li\u011finin bahar\u0131nda ge\u00e7ti\u011fimiz g\u00fcnlerde hayat\u0131na son veren h\u00e2kim aday\u0131 Didem Yaylal\u0131 ve bu durumdaki yarg\u0131 mensuplar\u0131n\u0131n yaralar\u0131na merhem olamamaktan dersler \u00e7\u0131karm\u0131\u015f olmam\u0131z\u0131 diliyorum.<\/p>\n<p>Programa renk katan Devlet \u00c7ok Sesli Korosu&#8217;na te\u015fekk\u00fcr ediyorum. Sanattan uzak hukuk\u00e7ular\u0131n\u0131n ve idarecilerin \u00e7a\u011fda\u015fl\u0131k yolunda ilerlemeyi sa\u011flayamayaca\u011f\u0131n\u0131 bilgilerinize sunuyorum.<\/p>\n<p>9 A\u011fustos 1969&#8217;da kurulan T\u00fcrkiye Barolar Birli\u011fi\u2019nin 44. kurulu\u015f y\u0131ld\u00f6n\u00fcm\u00fcn\u00fc k\u0131sa bir s\u00fcre \u00f6nce idrak ettik.<\/p>\n<p>\u201cSavunman\u0131n savunulmas\u0131n\u0131n zorunlu hale geldi\u011fi bir ortamda \u201ckutlad\u0131k\u201d diyemiyorum; \u201cidrak ettik\u201d diyorum.<\/p>\n<p>\u00c7a\u011fda\u015f hukukun avukatlar i\u00e7in kabul etti\u011fi;<br \/>\n\u2022Hi\u00e7 bir bask\u0131, engelleme, taciz veya hukuka ayk\u0131r\u0131 m\u00fcdahaleyle kar\u015f\u0131la\u015fmadan her t\u00fcrl\u00fc mesleki faaliyeti yerine getirmeleri,<br \/>\n\u2022G\u00f6revlerini icra ederken g\u00fcvenlikleri tehdit edildi\u011finde korunmalar\u0131,<br \/>\n\u2022Yarg\u0131 yerleri ve idari makamlar \u00f6n\u00fcnde yaz\u0131l\u0131 ve s\u00f6zl\u00fc taleplerinde hukuki ve cezai muafiyetlerden yararlanmalar\u0131,<br \/>\n\u2022M\u00fcvekkilleriyle ileti\u015fimlerinin gizlili\u011fi gibi ilkelerin ihlal edildi\u011fi bir ortamday\u0131z.<\/p>\n<p>Bug\u00fcn, savunma bask\u0131 alt\u0131ndad\u0131r. Avukatlar, mesleki faaliyetleri nedeniyle soru\u015fturulmakta ve kovu\u015fturulmaktad\u0131r. Adliyelerden ve duru\u015fma salonlar\u0131ndan yaka pa\u00e7a \u00e7\u0131kar\u0131lmakta, savunma g\u00f6revinden yasaklanmaktad\u0131r.<\/p>\n<p>Say\u0131n Cumhurba\u015fkan\u0131m,<\/p>\n<p>Avukata mesle\u011fini icra ederken tan\u0131nan g\u00fcvenceler hi\u00e7bir \u015fekilde \u015fahsi ayr\u0131cal\u0131klar de\u011fildir. \u015e\u00f6yle ki, uluslararas\u0131 hukuk metinlerinde, anayasalarda veya kanunlarda b\u00fcy\u00fck harflerle yaz\u0131lan haklar, insanlar\u0131n kullan\u0131m\u0131na sunulmad\u0131\u011f\u0131 takdirde fazla bir anlam ifade etmez. Avukat\u0131n g\u00f6revi, bu haklar\u0131 insanlar\u0131n kullan\u0131m\u0131na sunmakt\u0131r. \u015eu halde avukat, toplum i\u00e7inde ya\u015fayan insan\u0131 birey yapan meslek mensubudur. Avukat\u0131n hak ve yetkilerine veya avukat\u0131n do\u011frudan do\u011fruya ya\u015fam\u0131na ya da v\u00fccut b\u00fct\u00fcnl\u00fc\u011f\u00fcne y\u00f6nelen her sald\u0131r\u0131, asl\u0131nda bireye y\u00f6nelmi\u015ftir. \u00d6yleyse e\u011fer bir yerde avukat yerde s\u00fcr\u00fckleniyorsa, asl\u0131nda yerde s\u00fcr\u00fcklenen yurtta\u015ft\u0131r.<\/p>\n<p>Barolar ve onlar\u0131n \u00e7at\u0131 kurulu\u015fu T\u00fcrkiye Barolar Birli\u011fi, avukatlar\u0131n \u00f6rg\u00fctl\u00fc g\u00fcc\u00fcd\u00fcr. Nitekim barolara ve T\u00fcrkiye Barolar Birli\u011fi\u2019ne Avukatl\u0131k Kanunu\u2019nun 76. ve 110. maddeleriyle \u201chukukun \u00fcst\u00fcnl\u00fc\u011f\u00fcn\u00fc ve insan haklar\u0131n\u0131 savunmak ve korumak, bu kavramlara i\u015flerlik kazand\u0131rmak\u201d g\u00f6revinin verilmesinin sebebi, avukat\u0131n toplum i\u00e7indeki vazge\u00e7ilmez yeri ve \u00f6nemidir.<\/p>\n<p>Y\u00f6netim modeli ne olursa olsun tarih boyunca her devlet uyu\u015fmazl\u0131klar\u0131 yarg\u0131lamakla g\u00f6revli olan kurumlar tesis etmi\u015f, g\u00f6revliler atam\u0131\u015ft\u0131r.<\/p>\n<p>Ba\u015fka bir anlat\u0131mla, ister totaliter veya otoriter ister demokratik olsun b\u00fct\u00fcn devletlerde uyu\u015fmazl\u0131klar\u0131 \u00e7\u00f6zmek \u00fczere kurulmu\u015f mahkemeler vard\u0131r. Ancak sadece demokratik hukuk devletlerinde etkin ve yarg\u0131n\u0131n kurucu unsuru niteli\u011fini ta\u015f\u0131yan ba\u011f\u0131ms\u0131z savunmadan s\u00f6z edilebilir.<\/p>\n<p>Demokratik hukuk devletlerinde mahkemelerin g\u00f6revi adli yollar kullanmak suretiyle iddian\u0131n do\u011frulu\u011funu ara\u015ft\u0131rmak, do\u011fruyu yanl\u0131\u015ftan, su\u00e7luyu su\u00e7suzdan ay\u0131rt etmektir. Adli yoldan kas\u0131t, evrenselle\u015fmi\u015f \u00f6l\u00e7\u00fctlere uygun hukuk kurallar\u0131yla belirlenmi\u015f olan yoldur. Bu noktada kar\u015f\u0131m\u0131za, adil yarg\u0131lanma hakk\u0131 \u00e7\u0131kar. \u00c7a\u011fda\u015f ceza muhakemesinin amac\u0131, ki\u015fileri lekelemeden, toplumu ezmeden ve sindirmeden, her bireyin hukuki g\u00fcvenlik hakk\u0131n\u0131 peki\u015ftirerek, demokratik hak ve h\u00fcrriyetlerini kullananlar\u0131 hi\u00e7bir korkuya hatta endi\u015feye dahi sevk etmeyecek \u015fekilde ger\u00e7e\u011fe ula\u015fmaya gayret etmektir.<\/p>\n<p>\u015eu halde, adli yol ve onun i\u00e7inde yer alan adil yarg\u0131lanma hakk\u0131 g\u00f6z ard\u0131 edilip, \u201cne pahas\u0131na olursa olsun ger\u00e7e\u011fe ula\u015f\u0131lacakt\u0131r\u201d diye \u00e7\u0131k\u0131lan bir yolun sonunda, hem ger\u00e7e\u011fe ula\u015f\u0131lamaz hem de soru\u015fturma ve kovu\u015fturma s\u00fcreci, kamu d\u00fczenini, soru\u015fturulan veya kovu\u015fturulan su\u00e7tan daha fazla ihlal eder. \u015e\u00f6yle ki, adli yoldan sap\u0131lan, adil yarg\u0131lanma hakk\u0131 ihlal edilen her durumda, sadece soru\u015fturulan veya kovu\u015fturulan bireyler de\u011fil, \u00fc\u00e7\u00fcnc\u00fc ki\u015filer de temel hak ve \u00f6zg\u00fcrl\u00fcklerinden, hukuki g\u00fcvenliklerinden endi\u015fe etmeye ba\u015flarlar.<\/p>\n<p>Unutulmamal\u0131d\u0131r ki, bir ki\u015fi hayat\u0131 boyunca su\u00e7 i\u015flemeyece\u011fini taahh\u00fct edebilir ve bu s\u00f6z\u00fcne de sad\u0131k kalabilir. Ancak hi\u00e7 kimse hayat\u0131nda bir g\u00fcn yarg\u0131lan\u0131p yarg\u0131lanmayaca\u011f\u0131n\u0131 bilemez. \u0130\u015fte bu sebeple \u00e7a\u011fda\u015f ceza muhakemesinin kurallar\u0131, su\u00e7suzluk karinesi temel hakk\u0131 ekseninde, bir yandan su\u00e7u kesin h\u00fck\u00fcmle sabit oluncaya kadar \u015f\u00fcpheli ve san\u0131\u011f\u0131, di\u011fer yandan hayatlar\u0131nda bir g\u00fcn su\u00e7lanabileceklerini ya da yarg\u0131lanabileceklerini bilmesi gereken toplumun di\u011fer b\u00fct\u00fcn bireylerini korur.<\/p>\n<p>Adil yarg\u0131lanma hakk\u0131n\u0131n hukuk uygulamac\u0131lar\u0131 taraf\u0131ndan i\u00e7selle\u015ftirilmedi\u011fi, dolay\u0131s\u0131yla s\u0131k s\u0131k ihlal edildi\u011fi toplumlarda bireyler, temel hak ve \u00f6zg\u00fcrl\u00fcklerinin her an devlet taraf\u0131ndan ihlal edilebilece\u011fi korkusuyla ya\u015farlar; kendilerini ifade etmekten \u00e7ekinmeye ba\u015flarlar; devlet ayg\u0131t\u0131n\u0131 bir hizmet arac\u0131 olarak de\u011fil korkulan bir \u201cb\u00fcy\u00fck abi\u201d olarak alg\u0131larlar.<\/p>\n<p>Say\u0131n Cumhurba\u015fkan\u0131m,<\/p>\n<p>\u00c7a\u011fda\u015f demokratik hukuk\/devlet\/toplum d\u00fczenlerinde muhakeme hukukunun geldi\u011fi a\u015famada, \u201cger\u00e7ek\u201de, s\u00f6zlerin \u00e7arp\u0131\u015fmas\u0131yla ula\u015f\u0131labilece\u011fi kabul edilmektedir. Bunun i\u00e7in birbirine e\u015fit \u00fc\u00e7 makama ihtiya\u00e7 vard\u0131r:<br \/>\n\u2022Mahkemelerden ve h\u00e2kimlerden olu\u015fan yarg\u0131lama makam\u0131,<br \/>\n\u2022Yarg\u0131lama makam\u0131n\u0131n tamamen d\u0131\u015f\u0131nda \u00f6rg\u00fctlenmi\u015f iddia makam\u0131,<br \/>\n\u2022Yarg\u0131lama ve iddia makamlar\u0131 ile siyasi iktidardan tamamen ba\u011f\u0131ms\u0131z avukatlar\u0131n olu\u015fturdu\u011fu savunma makam\u0131.<\/p>\n<p>S\u00f6z konusu makamlar\u0131n tamam\u0131 yarg\u0131n\u0131n kurucu unsurudur.<\/p>\n<p>Bu unsurlardan mahkemeler ve h\u00e2kimler ba\u011f\u0131ms\u0131z ve tarafs\u0131z olmad\u0131klar\u0131 takdirde, adil yarg\u0131lamadan ve dolay\u0131s\u0131yla yarg\u0131n\u0131n adalet da\u011f\u0131tt\u0131\u011f\u0131ndan s\u00f6z edilemez.<\/p>\n<p>\u00d6te yandan, h\u00e2kimler ve savc\u0131lar birbirine yakla\u015f\u0131r ve savunma makam\u0131ndan uzakla\u015f\u0131rsa, muhakemede ger\u00e7e\u011fe ula\u015f\u0131lmas\u0131n\u0131n vazge\u00e7ilmez ko\u015fulu olan \u201chi\u00e7 kimse kendi davas\u0131nda h\u00e2kim olamaz\u201d ilkesi \u00f6z\u00fcnden ihlal edilmi\u015f olur. \u00c7\u00fcnk\u00fc s\u0131fat olarak iddia eden ve yarg\u0131layan makamlar birbirinden ayr\u0131 gibi g\u00f6r\u00fcnse de uygulamada meydana gelen fiili yak\u0131nla\u015fma ve hatta birle\u015fmeler, iddia makam\u0131n\u0131n ayn\u0131 zamanda fiilen yarg\u0131lama yap\u0131p h\u00fck\u00fcm vermesi sonucunu do\u011furur.<\/p>\n<p>H\u00e2kimlerin tarafs\u0131z ve ba\u011f\u0131ms\u0131z olmalar\u0131 ne kadar \u00f6nemliyse kanun koyucu veya idari makamlar\u0131n yerine ge\u00e7erek yasama organ\u0131 ya da h\u00fck\u00fcmet gibi davranmalar\u0131 da kabul edilemez. Ba\u015fka bir anlat\u0131mla, devlet i\u00e7inde ayr\u0131 devletler olmaz; yarg\u0131 mensuplar\u0131n\u0131n devletin i\u00e7inden veya d\u0131\u015f\u0131ndan kimi yap\u0131larca \u201cbenim h\u00e2kimim\u201d, \u201csenin h\u00e2kimin\u201d diye s\u0131n\u0131fland\u0131r\u0131lmas\u0131 izah dahi olunamaz. Bu tart\u0131\u015fmalar\u0131n yap\u0131ld\u0131\u011f\u0131 bir \u00fclkede hi\u00e7 kimsenin hukuki g\u00fcvenli\u011fi kalmaz. Adalet m\u00fclk\u00fcn temeli ise, m\u00fclk temelsiz kal\u0131r.<\/p>\n<p>Adil yarg\u0131lanma hakk\u0131n\u0131n vazge\u00e7ilmez ko\u015fulu, ba\u011f\u0131ms\u0131z, etkili, dolay\u0131s\u0131yla yarg\u0131n\u0131n kurucu unsuru niteli\u011fini ta\u015f\u0131yan bir \u201csavunma\u201dn\u0131n varl\u0131\u011f\u0131d\u0131r. Savunma makam\u0131n\u0131n di\u011fer iki makam kar\u015f\u0131s\u0131nda g\u00fc\u00e7s\u00fcz b\u0131rak\u0131lmas\u0131 ve adalete ula\u015f\u0131lmas\u0131n\u0131 sa\u011flamakta vazge\u00e7ilmez i\u015flevinin di\u011fer iki makam taraf\u0131ndan i\u00e7selle\u015ftirilmemesi durumunda da, iddia makam\u0131n\u0131n ileri s\u00fcrd\u00fc\u011f\u00fc tezin kar\u015f\u0131s\u0131na etkili bir anti tez \u00e7\u0131kar\u0131lamaz. Bu durumda yarg\u0131lamada ger\u00e7e\u011fe ve adalete ula\u015f\u0131lmas\u0131 beklenemez.<\/p>\n<p>B\u00f6yle bir yarg\u0131lamada, su\u00e7lu su\u00e7suzdan, do\u011fru yanl\u0131\u015ftan ayr\u0131lamaz. Var\u0131lan sonu\u00e7, \u201cger\u00e7ek\u201d de\u011fil, mahkemelerin veya mahkemeleri etkileyen g\u00fc\u00e7lerin ger\u00e7ek olarak g\u00f6stermek istedikleri bir aldatmacadan ibaret olur.<\/p>\n<p>\u00dclkemizde, H\u00e2kimler ve Savc\u0131lar Y\u00fcksek Kurulu\u2019nun h\u00e2kim ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131, h\u00e2kim ve savc\u0131 teminat\u0131n\u0131 sa\u011flayamad\u0131\u011f\u0131n\u0131 tespit etmek zorunday\u0131z. \u00d6te yandan yap\u0131ld\u0131\u011f\u0131 s\u00f6ylenen reformlara ra\u011fmen, adil yarg\u0131lama sorununun k\u00f6k\u00fcne hen\u00fcz inilmemi\u015f, belki de inilmek istenmemi\u015ftir. \u00dcz\u00fclerek belirtmeliyiz ki h\u00e2kim ve savc\u0131lar ayn\u0131 yerde staj e\u011fitimi g\u00f6rmenin, ayn\u0131 makam taraf\u0131ndan \u00f6zl\u00fck i\u015flerine bak\u0131l\u0131yor olmas\u0131n\u0131n, ayn\u0131 lojmanlarda kalmalar\u0131n\u0131n, adliyelerde keyfi bir \u015fekilde avukatlara kapat\u0131lan \u00f6zel kap\u0131lardan ge\u00e7menin, \u00f6zel asans\u00f6rlere binmenin, kom\u015fu odalarda oturmalar\u0131n\u0131n ve iki meslek grubu aras\u0131nda kolayl\u0131kla ge\u00e7i\u015f olmas\u0131n\u0131n etkisiyle, kendilerini, birbirlerine yak\u0131n, hatta \u00f6zde ayn\u0131 g\u00f6rmekte, avukatlar\u0131 ise kurucu unsur olarak kabul etmeye direnmektedirler. Dolay\u0131s\u0131yla avukat\u0131n yarg\u0131n\u0131n kurucu unsuru olarak benimsenmedi\u011fi bir yerde, adil yarg\u0131lanma hakk\u0131n\u0131n hayata ge\u00e7irildi\u011finden bahsetmek m\u00fcmk\u00fcn de\u011fildir.<\/p>\n<p>Maalesef \u00fclkemizde, uygulamada, savunman\u0131n kutsall\u0131\u011f\u0131ndan s\u00fcrekli dem vurulsa da, savunman\u0131n hala kurucu unsur olarak say\u0131lmad\u0131\u011f\u0131n\u0131, ger\u00e7e\u011fe ula\u015f\u0131lmas\u0131nda engel olarak kabul edildi\u011fini g\u00f6r\u00fcyoruz.<\/p>\n<p>Kanunun a\u00e7\u0131k h\u00fckm\u00fcne ra\u011fmen avukatl\u0131k mesle\u011finin kamu hizmeti niteli\u011fini g\u00f6z ard\u0131 eden ve salt serbest meslek olarak g\u00f6ren Dan\u0131\u015ftay 8. Dairesi\u2019nin 05.11.2012 g\u00fcn ve 2012\/5257 Esas say\u0131l\u0131 y\u00fcr\u00fctmeyi durdurma karar\u0131n\u0131n gerek\u00e7esini i\u00e7imize sindiremiyor ve ele\u015ftiriyoruz.<\/p>\n<p>Avukatl\u0131k Kanunu\u2019nun 46\/2. maddesinin a\u00e7\u0131k h\u00fckm\u00fcne ra\u011fmen, avukat\u0131n Yarg\u0131tay\u2019da dosya g\u00f6rmesini vek\u00e2letname ibraz\u0131na ba\u011flayan Yarg\u0131tay Ba\u015fkanlar Kurulu\u2019nun hukuka ayk\u0131r\u0131 idari i\u015fleminin geri al\u0131nmas\u0131n\u0131 80 bin avukat ad\u0131na talep ediyorum. B\u00fct\u00fcn bunlar\u0131n sayg\u0131 s\u0131n\u0131rlar\u0131n\u0131 zorlayan, avukatlara ve barolara k\u00fc\u00e7\u00fcmseyici bak\u0131\u015f a\u00e7\u0131s\u0131n\u0131 sergileyen, i\u015fbirli\u011fini engelleyen bir uygulama oldu\u011funu huzurlar\u0131n\u0131zda \u00fcz\u00fclerek ifade ediyor; Yarg\u0131tay\u2019\u0131, Y\u00fcce Yarg\u0131tay\u2019a \u015fik\u00e2yet ediyorum.<\/p>\n<p>Bu karar\u0131 veren say\u0131n h\u00e2kimlerin bir g\u00fcn avukatl\u0131k mesle\u011fine ge\u00e7tiklerinde, i\u00e7eri\u011fini bilmedikleri dosyalara, s\u0131rf i\u00e7eri\u011fini \u00f6\u011frenebilmek ve buna g\u00f6re davay\u0131 al\u0131p almamaya karar verebilmek i\u00e7in vek\u00e2letname koymak zorunda kald\u0131klar\u0131nda, kararlar\u0131n\u0131n ne kadar yanl\u0131\u015f oldu\u011funu anlayacaklar\u0131n\u0131 \u00e7ok iyi biliyorum. Avukatlar etkili bir sosyal g\u00fcvenceden hala yoksundurlar. Kontrols\u00fcz a\u00e7\u0131lan hukuk fak\u00fcltelerinden yeterli e\u011fitimi almam\u0131\u015f hukuk fak\u00fcltesi mezunlar\u0131 s\u0131navs\u0131z bir \u015fekilde avukatl\u0131k staj\u0131na ba\u015flay\u0131p kolayl\u0131kla avukat olmakta, sonu\u00e7ta hem hizmetin kalitesi d\u00fc\u015fmekte hem de avukatlar b\u00fcy\u00fck ekonomik zorluklara s\u00fcr\u00fcklenmektedir. T\u00fcrkiye Barolar Birli\u011fi olarak bu konularda \u00fczerimize d\u00fc\u015feni yapmaya daima haz\u0131r\u0131z. Bu \u00e7er\u00e7evede avukatl\u0131k staj\u0131nda kalitenin artt\u0131r\u0131lmas\u0131 ve etkili de\u011ferlendirme y\u00f6ntemlerinin getirilmesine ili\u015fkin d\u00fczenleme \u00e7al\u0131\u015fmalar\u0131m\u0131z son a\u015famaya gelmi\u015f bulunmaktad\u0131r. Hukuk fak\u00fcltelerinin a\u00e7\u0131lmas\u0131 ve m\u00fcfredatlar\u0131n\u0131n belirlenmesi konusunda buradan Y\u00fcksek \u00d6\u011fretim Kurulu\u2019na i\u015fbirli\u011fi \u00e7a\u011fr\u0131s\u0131nda bulunuyoruz.<\/p>\n<p>Anayasa de\u011fi\u015fikli\u011fine ili\u015fkin uzla\u015fma komisyonunun \u00e7al\u0131\u015fmalar\u0131nda avukatlara ve barolara yarg\u0131 b\u00f6l\u00fcm\u00fcnde yer verilmi\u015f olmas\u0131n\u0131 olumlu kar\u015f\u0131lad\u0131\u011f\u0131m\u0131z\u0131 ifade etmek istiyorum. Ne var ki, ayn\u0131 d\u00fczenleme i\u00e7erisinde T\u00fcrkiye\u2019de avukatl\u0131k mesle\u011fine b\u00fcy\u00fck zararlar verecek ve avukatlar\u0131n yak\u0131n \u00e7evreleriyle birlikte yakla\u015f\u0131k 800 bin ki\u015fiyi do\u011frudan etkileyecek, milyonlarca yurtta\u015f\u0131m\u0131z\u0131n ise ekonomik g\u00fc\u00e7l\u00fck sebebiyle avukatl\u0131k hizmetinden yararlanmas\u0131n\u0131 fevkalade zorla\u015ft\u0131racak yabanc\u0131 avukatl\u0131k ortakl\u0131klar\u0131n\u0131n Anayasal g\u00fcvenceye kavu\u015fturulmak istenmesini \u015fiddetle k\u0131n\u0131yoruz.<\/p>\n<p>Y\u00fcr\u00fcrl\u00fckteki Avukatl\u0131k Kanunu, pek \u00e7ok y\u00f6nden anti demokratik, vesayet\u00e7i, mesle\u011fimiz a\u00e7\u0131s\u0131ndan \u00e7a\u011f\u0131n gerektirdi\u011fi ihtiya\u00e7lar\u0131 kar\u015f\u0131lamaktan uzakt\u0131r. T\u00fcrkiye Barolar Birli\u011fi olarak b\u00fct\u00fcn barolar\u0131n ve avukatlar\u0131n katk\u0131s\u0131n\u0131 sa\u011flamak suretiyle geni\u015f kesimleri tatmin edecek \u00e7a\u011fda\u015f bir kanun tasla\u011f\u0131 ortaya koymaya haz\u0131r\u0131z. Kat\u0131l\u0131mc\u0131 s\u00fcre\u00e7 i\u015fletilmeden, \u201cben yapt\u0131m oldu\u201d zihniyeti ile kar\u015f\u0131m\u0131za getirilecek kanun tasar\u0131s\u0131 veya gece yar\u0131s\u0131 teklifleriyle Avukatl\u0131k Kanunu\u2019nun de\u011fi\u015ftirilmesinin, hukuk devletine ve huzurlu bir toplumsal ya\u015fama a\u011f\u0131r darbe vuraca\u011f\u0131n\u0131n her t\u00fcrl\u00fc izahtan vareste oldu\u011funu hat\u0131rlatmak istiyorum.<\/p>\n<p>Yeni yap\u0131lacak olan Avukatl\u0131k Kanunu\u2019nda staja ve mesle\u011fe giri\u015f s\u0131navla ger\u00e7ekle\u015fmeli; avukatl\u0131k meslek alan\u0131, geli\u015fmi\u015f \u00fclkelerin mevzuatlar\u0131 model al\u0131narak \u00e7a\u011fda\u015f insanlar\u0131n ihtiya\u00e7lar\u0131na g\u00f6re yeniden planlanmal\u0131d\u0131r.<\/p>\n<p>Barolar\u0131n ve T\u00fcrkiye Barolar Birli\u011fi\u2019nin \u00fczerinden idarenin vesayeti tamamen kald\u0131r\u0131lmal\u0131, noterlerinkine benzer bir avukat destek havuzu olu\u015fturulmal\u0131, avukatl\u0131\u011f\u0131n bir kamu hizmeti oldu\u011fu dikkate al\u0131narak belirli bir k\u0131demin \u00fcst\u00fcndeki avukatlara ye\u015fil pasaport hakk\u0131 tan\u0131nmal\u0131, avukat\u0131n delil toplama yetkisine dayanarak ileri s\u00fcrd\u00fc\u011f\u00fc taleplerin yerine getirilmemesi etkili yapt\u0131r\u0131mlara ba\u011flanmal\u0131, avukat\u0131n yarg\u0131n\u0131n kurucu unsuru oldu\u011fu peki\u015ftirilmeli, avukatlar\u0131n barolar\u0131n ve T\u00fcrkiye Barolar Birli\u011fi\u2019nin varl\u0131k sebebini kabullenmeyi reddeden yarg\u0131sal uygulamalara kar\u015f\u0131 g\u00fcvence sa\u011flayacak \u015fekilde Avukatl\u0131k Kanunu yeniden yaz\u0131lmal\u0131d\u0131r.<\/p>\n<p>Bu noktada, seslerini buradan duyurma imk\u00e2nlar\u0131 olmayan adliye personelinin de da\u011f gibi b\u00fcy\u00fcm\u00fc\u015f sorunlar\u0131na art\u0131k \u00e7\u00f6z\u00fcm bulunmas\u0131 gerekti\u011fini ifade etmeyi bir g\u00f6rev biliyorum. Bu \u00e7er\u00e7evede, adliye emek\u00e7ilerinin saatlerce bilgisayar kullan\u0131m\u0131ndan ve olumsuz \u00e7al\u0131\u015fma ko\u015fullar\u0131ndan kaynaklanan ciddi sa\u011fl\u0131k sorunlar\u0131ndan tutun da, fazla \u00e7al\u0131\u015fma \u00fccreti alamamalar\u0131na ve 4\/c\u2019li personelin kadrosuz \u00e7al\u0131\u015ft\u0131r\u0131l\u0131yor olmas\u0131na kadar \u00e7ok say\u0131da sorunun \u00e7\u00f6z\u00fcm bekledi\u011fini bilgilerinize sunuyorum.<\/p>\n<p>Say\u0131n Cumhurba\u015fkan\u0131m,<\/p>\n<p>Y\u00fcksek huzurlar\u0131n\u0131zda kanunun a\u00e7\u0131k h\u00fckm\u00fc gere\u011fi korumakla y\u00fck\u00fcml\u00fc oldu\u011fumuz demokratik, laik, sosyal hukuk devletine ili\u015fkin baz\u0131 tespit ve de\u011ferlendirmelerimi arz etmek istiyorum.<\/p>\n<p>Hukuk devleti, insan haklar\u0131na sayg\u0131 g\u00f6steren ve bu haklar\u0131 korumak \u00fczere adil bir hukuk d\u00fczeni kuran ve bunu devam ettirmeye kendisini zorunlu sayan ve faaliyetlerinde hukuka ve anayasaya uyan bir devlettir. Bu tan\u0131mlaman\u0131n i\u00e7inde \u00f6zg\u00fcr insan, hak ve y\u00fck\u00fcml\u00fcl\u00fcklerle donat\u0131lm\u0131\u015f yurtta\u015f yer al\u0131r. Demokratik hukuk devletinde, \u00fcst\u00fcnlerin hukuku de\u011fil, hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fc egemendir.<\/p>\n<p>Bu noktada son d\u00f6nemlerde s\u0131k\u00e7a telaffuz edilen \u201cmilli irade\u201dtabirini k\u0131saca de\u011ferlendirmekte fayda g\u00f6r\u00fcyorum. D\u00fcnya ve T\u00fcrkiye tarihine bak\u0131ld\u0131\u011f\u0131nda, milli irade tabiri daha ziyade, se\u00e7imle i\u015f ba\u015f\u0131na gelmi\u015f ancak \u00e7o\u011fulculuk yerine \u00e7o\u011funluk\u00e7ulu\u011fu benimsemi\u015f ve giderek otoriter e\u011filimler sergilemeye ba\u015flam\u0131\u015f siyasi iktidarlar\u0131n tercihi olmu\u015ftur. \u00c7a\u011fda\u015f demokrasiler ise \u00e7o\u011fulcudur. Ba\u015fka bir anlat\u0131mla \u00e7a\u011fda\u015f demokrasiler, sadece o an i\u00e7in \u00e7o\u011funlukta olan siyasi g\u00f6r\u00fc\u015fleri de\u011fil, say\u0131ca az\u0131nl\u0131kta olan ba\u015fka g\u00f6r\u00fc\u015fleri de kucaklar. Bug\u00fcn e\u011fer mutlaka milli irade tabiri kullan\u0131lmak isteniyorsa, T\u00fcrkiye Cumhuriyeti\u2019nin \u00e7o\u011fulcu bir demokrasi modeline dayand\u0131\u011f\u0131 unutulmamal\u0131d\u0131r. Bu durumda milli irade tabiri, \u00e7o\u011funlu\u011fun az\u0131nl\u0131\u011fa tahakk\u00fcm etti\u011fi, siyasi iktidar\u0131n her kurumu ele ge\u00e7irdi\u011fi ve ya\u015fam\u0131n her alan\u0131n\u0131 d\u00fczenlemeye soyundu\u011fu, insanlar\u0131n ya\u015fam bi\u00e7imine m\u00fcdahale etti\u011fi d\u00f6nemlerdeki i\u00e7eri\u011finden elbette ki farkl\u0131 anla\u015f\u0131lmak zorundad\u0131r.<\/p>\n<p>O halde \u00e7a\u011fda\u015f bir demokraside \u201cmilli irade\u201d tabirini kullanmaya devam etmek isteyenler, bu tabirin i\u00e7inde siyasi iktidara muhalif d\u00fc\u015f\u00fcncelerin de yer ald\u0131\u011f\u0131n\u0131, h\u00fck\u00fcmetlerin parlamentodaki \u00e7o\u011funluklar\u0131na dayanarak her istediklerini yapamayacaklar\u0131n\u0131 ve onlara oy vermeyenlerin de h\u00fck\u00fcmeti olduklar\u0131n\u0131; insanl\u0131\u011f\u0131n ortak de\u011ferlerini temsil eden hukukun genel ilkelerine, usul\u00fcne g\u00f6re y\u00fcr\u00fcrl\u00fc\u011fe konulmu\u015f insan haklar\u0131na ili\u015fkin uluslararas\u0131 s\u00f6zle\u015fmelere ve anayasaya uygun davran\u0131lmas\u0131n\u0131n zorunlu oldu\u011funu unutmamal\u0131d\u0131r. Anayasam\u0131z\u0131n de\u011fi\u015fmez maddelerinde ifadesini bulan Cumhuriyetin temel niteliklerinin siyasi iktidar\u0131 s\u0131n\u0131rlad\u0131\u011f\u0131 ve \u00e7o\u011funlu\u011fun az\u0131nl\u0131\u011fa tahakk\u00fcm\u00fcn\u00fc engelledi\u011fi de hi\u00e7bir zaman ak\u0131ldan \u00e7\u0131kar\u0131lmamal\u0131d\u0131r. Bu s\u0131n\u0131rlamalarla kastedilen, baz\u0131lar\u0131n\u0131n ileri s\u00fcrd\u00fc\u011f\u00fcn\u00fcn aksine, az\u0131nl\u0131\u011f\u0131n \u00e7o\u011funlu\u011fa tahakk\u00fcm\u00fc asla de\u011fildir; kastedilen, demokratik uzla\u015fma k\u00fclt\u00fcr\u00fcd\u00fcr, kat\u0131l\u0131mc\u0131 demokrasidir, ge\u00e7ici bir \u00e7o\u011funlu\u011fun ge\u00e7ici bir az\u0131nl\u0131k \u00fczerinde mutlak egemenlik kurmas\u0131n\u0131n \u00f6nlenmesidir; nas\u0131l ya\u015fayaca\u011f\u0131n\u0131, hangi okula gidece\u011fini, hangi inanca sahip olaca\u011f\u0131n\u0131, nerede ibadet edece\u011fini, hangi ahlak kural\u0131n\u0131 benimseyece\u011fini ki\u015filere dayatmaya kalk\u0131\u015fmamas\u0131d\u0131r.<\/p>\n<p>Demokratik hukuk devletinin, dolay\u0131s\u0131yla \u00e7a\u011fda\u015f bir toplumun en b\u00fcy\u00fck d\u00fc\u015fmanlar\u0131ndan biri, ku\u015fkusuz askeri darbelerdir. Askeri darbelerin demokrasi k\u00fclt\u00fcr\u00fcn\u00fc yok etti\u011fi, hi\u00e7bir soruna asla \u00e7are olmad\u0131\u011f\u0131, yeni ve \u00e7ok daha b\u00fcy\u00fck toplumsal sorunlara yol a\u00e7t\u0131\u011f\u0131 T\u00fcrkiye ve di\u011fer \u00fclkelerdeki tarihi \u00f6rneklerle kan\u0131tlanm\u0131\u015ft\u0131r. \u0130stisnas\u0131z b\u00fct\u00fcn askeri darbeler, demokrasinin vazge\u00e7ilmezi olan siyasi partilerin kurumsalla\u015fmas\u0131n\u0131 \u00f6nlemi\u015f, sivil toplum \u00f6rg\u00fctlenmelerine izin vermemi\u015f, demokrasinin bir ya\u015fam bi\u00e7imi olmas\u0131n\u0131 engellemi\u015f ve se\u00e7imden se\u00e7ime oy verilen, yeterli derinlikten yoksun bir demokrasi k\u00fclt\u00fcr\u00fc yaratm\u0131\u015ft\u0131r.<\/p>\n<p>Askeri darbelerin ne kadar b\u00fcy\u00fck felaketlere yol a\u00e7abilece\u011finin en g\u00fcncel \u00f6rne\u011fi, T\u00fcrkiye\u2019nin bu y\u00f6nden hakl\u0131 tepkisini ortaya koydu\u011fu M\u0131s\u0131r\u2019da ya\u015fanmaktad\u0131r. Bu tepkinin d\u00fcnya kamuoyu \u00fczerinde etkili olabilmesi i\u00e7in, \u00fclkemiz i\u00e7inde insan haklar\u0131na ve demokratik \u00f6zg\u00fcrl\u00fcklere azami sayg\u0131 g\u00f6sterilmesi gerekti\u011fi ku\u015fkusuzdur.<\/p>\n<p>\u0130ster \u00fclkemizde ister d\u00fcnyan\u0131n ba\u015fka bir yerinde olsun; bar\u0131\u015f\u00e7\u0131l g\u00f6steri hakk\u0131n\u0131 kullananlara \u015fiddet uygulanmas\u0131, g\u00f6stericilerin ger\u00e7ek mermilerle, hedef g\u00f6zetilerek s\u0131k\u0131lan gaz bombalar\u0131yla, plastik mermilerle veya kimyasal madde kar\u0131\u015ft\u0131r\u0131lm\u0131\u015f tazyikli sularla \u00f6ld\u00fcr\u00fclmesi ya da yaralanmas\u0131 a\u011f\u0131r bir su\u00e7tur. Bu su\u00e7lar\u0131 i\u015fleyenlerin te\u015fvik edilmeleri veya \u00f6d\u00fcllendirilmeleri de\u011fil, cezaland\u0131r\u0131lmalar\u0131 gerekir. Hi\u00e7bir siyasi veya ekonomik menfaat en \u00fcst\u00fcn de\u011fer olan insan ya\u015fam\u0131ndan daha de\u011ferli de\u011fildir. Sudan\u2019da, Lazkiye\u2019de, Rojava\u2019da, M\u0131s\u0131r\u2019\u0131n Adeviyesi\u2019nde veya Tahrir\u2019inde, Lice\u2019de, Uludere\u2019de, Reyhanl\u0131\u2019da, Ak\u00e7akale\u2019de, Ceylanp\u0131nar\u2019da, Eski\u015fehir\u2019in, Ankara\u2019n\u0131n, \u0130stanbul\u2019un ve Hatay\u2019\u0131n sokaklar\u0131nda, insanlar\u0131n katledilmesinin hi\u00e7bir mazereti olamaz.<\/p>\n<p>Demokratik bir devlette, devletin, d\u00fc\u015f\u00fcncenin ve ifadenin \u00f6n\u00fcn\u00fc a\u00e7mas\u0131, \u015fiddet \u00e7a\u011fr\u0131s\u0131 yapmayan d\u00fc\u015f\u00fcncelerin istenilen yerlere ula\u015ft\u0131r\u0131labilmesi i\u00e7in toplumsal ileti\u015fim kanallar\u0131n\u0131 a\u00e7\u0131k tutmas\u0131, bar\u0131\u015f\u00e7\u0131l toplant\u0131 ve g\u00f6sterileri engellememesi esast\u0131r. \u0130fade \u00f6zg\u00fcrl\u00fc\u011f\u00fc ve onun hayata ge\u00e7irilme y\u00f6ntemlerinden olan bar\u0131\u015f\u00e7\u0131l toplant\u0131 ve g\u00f6steriler, \u00f6zg\u00fcr ve demokratik bir toplumun varl\u0131\u011f\u0131n\u0131n en \u00f6nemli kan\u0131t\u0131d\u0131r.<\/p>\n<p>Demokrasilerde \u201cse\u00e7im sand\u0131\u011f\u0131\u201d ku\u015fkusuz vazge\u00e7ilmezdir. Ancak demokrasi, sand\u0131ktan sand\u0131\u011fa oy vermekle s\u0131n\u0131rl\u0131 bir rejim de\u011fil, bir ya\u015fam bi\u00e7imidir. Demokratik hukuk devletinde, siyasi iktidar, parlamentodaki \u00e7o\u011funlu\u011fu ne olursa olsun hukuk kurallar\u0131yla ba\u011fl\u0131 oldu\u011funu bilir. Hukuk kurallar\u0131n\u0131 uygulayanlar da daima \u00f6zg\u00fcrl\u00fck\u00e7\u00fc pencereden bakarlar. \u00c7\u00fcnk\u00fc demokratik hukuk devletinde \u00f6zg\u00fcrl\u00fckler esas, \u00f6zg\u00fcrl\u00fcklerin k\u0131s\u0131tlanmas\u0131 ise istisnad\u0131r.<\/p>\n<p>\u00d6zg\u00fcrl\u00fckler s\u00f6z konusu oldu\u011funda devlet, k\u0131s\u0131tlamak ve yasaklamak yerine engelleri kald\u0131rmakla y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n<p>Bu \u00e7er\u00e7evede, hi\u00e7 kimse d\u00fc\u015f\u00fcncelerini a\u00e7\u0131klad\u0131\u011f\u0131 i\u00e7in idari veya adli soru\u015fturmalara tabi tutulamaz. Anayasa\u2019ya, Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi\u2019ne ve Avrupa \u0130nsan Haklar\u0131 Mahkemesi kararlar\u0131na g\u00f6re; devletin g\u00fcvenlik g\u00fc\u00e7leri bar\u0131\u015f\u00e7\u0131l g\u00f6sterilere hi\u00e7bir \u015fekilde g\u00fc\u00e7 kullanarak m\u00fcdahale edemez. Bar\u0131\u015f\u00e7\u0131l g\u00f6sterilerde \u201cda\u011f\u0131l\u0131n\u201d uyar\u0131s\u0131 yap\u0131lmas\u0131, da\u011f\u0131lmayan g\u00f6stericilere g\u00fc\u00e7 kullan\u0131lmas\u0131n\u0131n mazereti olamaz. G\u00fc\u00e7 kullan\u0131lmas\u0131n\u0131n hakl\u0131 oldu\u011fu yerlerde ise gerekenden fazla g\u00fcc\u00fcn kullan\u0131lmas\u0131, \u00fczerinde g\u00fc\u00e7 kullan\u0131lan \u015fah\u0131s etkisiz hale getirildikten sonra da g\u00fc\u00e7 kullanarak keyfi ve fiili cezaland\u0131rma yoluna gidilmesi hi\u00e7 ku\u015fkusuz sorumluluk gerektirir. Sokak aralar\u0131nda, hatta g\u00fcnd\u00fcz g\u00f6z\u00fcyle \u015fehir meydanlar\u0131nda eli sopal\u0131 veya palal\u0131 ki\u015filerin polis memurlar\u0131n\u0131n deste\u011fiyle, te\u015fvikiyle veya korumas\u0131 alt\u0131nda yapt\u0131\u011f\u0131 katliamlar\u0131n ve \u015fiddet eylemlerinin ne kadar a\u011f\u0131r bir su\u00e7 te\u015fkil etti\u011fini a\u00e7\u0131klamay\u0131 gerekli dahi g\u00f6rm\u00fcyorum.<\/p>\n<p>Devletin emniyet g\u00fc\u00e7lerini, kanunu ihlal eden silahl\u0131 g\u00fc\u00e7lerden ay\u0131rt eden husus, emniyet g\u00fc\u00e7lerinin g\u00fc\u00e7 kullanma yetkisinin son derece s\u0131k\u0131 kurallarla d\u00fczenlenmi\u015f olmas\u0131d\u0131r. Devleti kutsalla\u015ft\u0131rmak isteyenler, asl\u0131nda kendilerini kutsalla\u015ft\u0131rmak ve dokunulmaz ilan etmek isterler. Bu d\u00fc\u015f\u00fcncede olanlar halka sunduklar\u0131 hizmetleri bir g\u00f6rev olarak de\u011fil, bir l\u00fctuf olarak g\u00f6r\u00fcrler. Kendi kendilerini halka hizmet ederken l\u00fctufta bulunduklar\u0131na inand\u0131ranlar, bireylerin muhalif d\u00fc\u015f\u00fcnceler a\u00e7\u0131klamas\u0131na, topluluklar\u0131n toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc yapmas\u0131na \u00f6fkelenirler ve halk\u0131 kadir bilmezlikle su\u00e7larlar.<\/p>\n<p>Siyasi iktidarlar, demokratik kitle \u00f6rg\u00fctlerinin ele\u015ftirilerinden elbette haz etmek zorunda de\u011fildir; ancak \u00e7o\u011fulcu demokrasilerde, siyasi iktidarlar, bu ele\u015ftirileri de\u011ferlendirmek ve ho\u015fg\u00f6r\u00fcyle kar\u015f\u0131lamak zorundad\u0131r. \u00c7o\u011fulcu demokrasilerde siyasi iktidarlar ho\u015flar\u0131na gitmeyen siyasi d\u00fc\u015f\u00fcnceleri hedef almazlar, parlamentodaki \u00e7o\u011funluklar\u0131na dayanarak demokratik kitle \u00f6rg\u00fctlerini yok etmeye kalk\u0131\u015fmazlar; bunlar\u0131 demokrasinin vazge\u00e7ilmezi olarak kabul ederler ve birlikte ya\u015farlar. B\u00f6ylece bindikleri demokrasi dal\u0131n\u0131 kendi elleriyle kesmezler.<\/p>\n<p>Esasen \u00e7o\u011fulcu demokrasi, ger\u00e7ek demokrasinin tek modelidir. \u00c7o\u011funluk\u00e7u rejimler kendi kendilerini demokrasi olarak ilan etseler de, o d\u00fczenlerde \u00f6zg\u00fcrl\u00fck yoktur, siyasi iktidar\u0131n l\u00fctuflar\u0131 vard\u0131r.<\/p>\n<p>Demokratik bir hukuk devletinde, d\u00fc\u015f\u00fcnme, d\u00fc\u015f\u00fcnd\u00fc\u011f\u00fcn\u00fc ifade etme ve bas\u0131n \u00f6zg\u00fcrl\u00fc\u011f\u00fc vazge\u00e7ilmezdir. Bas\u0131n \u00f6zg\u00fcrl\u00fc\u011f\u00fcne y\u00f6nelik en b\u00fcy\u00fck tehdit yaln\u0131zca gazetecilere a\u00e7\u0131lan davalar veya gazete sahiplerine y\u00f6nelik idari-mali uygulamalar ve gazetelerin uygulamak zorunda kald\u0131klar\u0131 otosans\u00fcr de\u011fil, tekelle\u015fme ve bas\u0131n \u00e7al\u0131\u015fanlar\u0131n\u0131n \u00f6rg\u00fctlenmesinin \u00f6n\u00fcne getirilen k\u0131s\u0131tlamalard\u0131r. Bu \u00f6zg\u00fcrl\u00fckler k\u0131s\u0131tland\u0131\u011f\u0131nda muhalefet partilerinin ve demokratik kitle \u00f6rg\u00fctlerinin etkili muhalefet yapma imk\u00e2nlar\u0131 ellerinden al\u0131n\u0131r. Bu durumda ne kadar bask\u0131 alt\u0131nda tutulursa tutulsun, toplum bir noktada patlar ve toplumsal muhalefet, siyasal muhalefetin \u00f6n\u00fcne ge\u00e7er. Toplumsal olaylar kar\u015f\u0131s\u0131nda siyasi iktidarlar, ba\u015fkalar\u0131n\u0131 su\u00e7layarak savunmaya ge\u00e7mek yerine, olaylar\u0131n ger\u00e7ek sebeplerini bulmaya, toplumun s\u0131k\u0131nt\u0131s\u0131n\u0131 anlamaya \u00e7al\u0131\u015fmal\u0131d\u0131r. Su\u00e7lamak kolay, \u00e7\u00f6z\u00fcm bulmak zordur. Ancak demokrasi, zoru ba\u015farmay\u0131 gerektirir. Bu ba\u015far\u0131n\u0131n anahtar\u0131 ise ho\u015fg\u00f6r\u00fc, uzla\u015fma ve ortak ak\u0131lda gizlidir.<\/p>\n<p>Say\u0131n Cumhurba\u015fkan\u0131m,<\/p>\n<p>\u00d6zel G\u00f6revli Mahkemeler ve Ter\u00f6rle M\u00fccadele Mahkemeleri, ola\u011fan d\u00f6nemlerin ola\u011fan\u00fcst\u00fc mahkemeleridir. Nas\u0131l ki anti demokratik olduklar\u0131 i\u00e7in en sonunda kald\u0131r\u0131lmak zorunda kal\u0131nan Devlet G\u00fcvenlik Mahkemeleri\u2019nin ihtisas mahkemeleri oldu\u011funa y\u00f6nelik a\u00e7\u0131klamalar ve T\u00fcrkiye\u2019nin Avrupa \u0130nsan Haklar\u0131 Mahkemesi\u2019ne bu y\u00f6nde yapt\u0131\u011f\u0131 savunmalar inand\u0131r\u0131c\u0131 bulunmad\u0131ysa, \u00d6zel G\u00f6revli Mahkemelerin ve Ter\u00f6rle M\u00fccadele Mahkemeleri\u2019nin ihtisas mahkemeleri oldu\u011funa dair a\u00e7\u0131klamalar da objektif \u00f6l\u00e7\u00fctler kar\u015f\u0131s\u0131nda inand\u0131r\u0131c\u0131 de\u011fildir. Maalesef Anayasa Mahkemesi\u2019nin 04.07.2013 g\u00fcn ve 2012\/100 E., 2013\/84 K. say\u0131l\u0131 karar\u0131nda, eski al\u0131\u015fkanl\u0131klar\u0131 tekrarlar \u015fekilde, Ter\u00f6rle M\u00fccadele Mahkemesi\u2019nin ihtisas mahkemesi oldu\u011fu kabul edilmi\u015f ve anayasal dayana\u011f\u0131 olmayan bu mahkemelere anayasall\u0131k vizesi verilmi\u015ftir.<\/p>\n<p>Malumlar\u0131n\u0131z oldu\u011fu \u00fczere \u00d6zel G\u00f6revli Mahkemeler, TBMM taraf\u0131ndan anti demokratik uygulamalar\u0131 sebebiyle kald\u0131r\u0131lm\u0131\u015ft\u0131r. Ancak hukuk mant\u0131\u011f\u0131yla izah\u0131 m\u00fcmk\u00fcn olmayacak \u015fekilde bu mahkemelerin ellerindeki davalar\u0131 bitirinceye kadar g\u00f6rev yapmalar\u0131na imk\u00e2n tan\u0131nm\u0131\u015ft\u0131r. Anayasa Mahkemesi s\u00f6z\u00fc edilen karar\u0131nda, bu durumu tabii h\u00e2kim ilkesiyle a\u00e7\u0131klam\u0131\u015f ve anayasaya ayk\u0131r\u0131 bulmam\u0131\u015ft\u0131r. \u0130nsan sa\u011fl\u0131\u011f\u0131na zararl\u0131 oldu\u011fu tespit edildi\u011finde piyasadan kald\u0131r\u0131lmas\u0131na karar verilen bir ilac\u0131n eczanelerdeki stoklar t\u00fckeninceye kadar sat\u0131lmas\u0131na izin verilemeyece\u011fi tabiidir. Ayn\u0131 \u015fekilde demokratik hukuk devletinde yeri olmad\u0131\u011f\u0131, anti demokratik oldu\u011fu bizzat yasama organ\u0131 taraf\u0131ndan tespit edilen \u00d6zel G\u00f6revli Mahkemelerin yarg\u0131lama yapmaya devam etmelerine, dolay\u0131s\u0131yla yarg\u0131lad\u0131klar\u0131 san\u0131klar\u0131n haklar\u0131na y\u00f6nelik ihlallerini s\u00fcrd\u00fcrmelerine izin verilmemeliydi. Anayasa Mahkemesi\u2019nin bu karar\u0131yla, tabii h\u00e2kim ilkesinin tan\u0131m\u0131 ve i\u015flevi de a\u011f\u0131r yara alm\u0131\u015ft\u0131r.<\/p>\n<p>Yine Anayasa Mahkemesi\u2019nin an\u0131lan karar\u0131nda, 10 y\u0131la kadar tutuklulu\u011fa izin veren kanuni d\u00fczenleme iptal edildikten sonra, bu iptal karar\u0131n\u0131n y\u00fcr\u00fcrl\u00fc\u011fe girmesinin Resmi Gazete\u2019de yay\u0131mlanmas\u0131ndan 1 y\u0131l sonraya ertelenmesini ve buna gerek\u00e7e olarak iptal karar\u0131n\u0131n derhal y\u00fcr\u00fcrl\u00fc\u011fe girmesi durumunda kamu d\u00fczeninin ihlal edilece\u011finden s\u00f6z edilmesini anlamak m\u00fcmk\u00fcn de\u011fildir. \u015e\u00f6yle ki iptal karar\u0131 tutuklama kurumunu ortadan kald\u0131rmam\u0131\u015f, sadece tutuklulukta azami s\u00fcrelerden olan 10 y\u0131ll\u0131k s\u00fcreyi iptal etmi\u015ftir. Bu iptal, bir ay\u0131b\u0131n ortadan kald\u0131r\u0131lmas\u0131d\u0131r. S\u00f6z konusu ay\u0131p ortadan kald\u0131r\u0131ld\u0131\u011f\u0131nda bir di\u011fer azami s\u00fcre olan 5 y\u0131ll\u0131k s\u00fcrenin uygulanaca\u011f\u0131 a\u00e7\u0131kt\u0131r. Dolay\u0131s\u0131yla iptal karar\u0131 hi\u00e7bir bo\u015fluk do\u011furmayacakt\u0131r. Anayasa Mahkemesi\u2019nin gerek\u00e7eli karar\u0131nda, derhal uygulaman\u0131n kamu d\u00fczenini ihlal edece\u011finden bahsedilmesi mahkemelerce bir talimat olarak alg\u0131lanm\u0131\u015f ve yerle\u015fik uygulamadan sap\u0131larak, temel hak ve h\u00fcrriyetlere ili\u015fkin bir iptal karar\u0131n\u0131n derhal uygulanmas\u0131 zorunlulu\u011fu g\u00f6rmezden gelinmi\u015ftir.<\/p>\n<p>Say\u0131n Cumhurba\u015fkan\u0131m,<\/p>\n<p>\u00d6zellikle son birka\u00e7 y\u0131lda, \u201cyarg\u0131 reformu\u201d ad\u0131 alt\u0131nda yap\u0131lan de\u011fi\u015fiklikler, yasa yapma tekni\u011fine ayk\u0131r\u0131 bir \u015fekilde \u201ctorba yasalarla\u201d ger\u00e7ekle\u015ftirilmeye \u00e7al\u0131\u015f\u0131lmaktad\u0131r. Torba yasa y\u00f6ntemi, kamuoyunun ve ilgili demokratik kitle \u00f6rg\u00fctlerinin yasala\u015fma s\u00fcrecini takip etmelerini engelleyen, sistematikten uzak, deneme yan\u0131lma yolunu esas alan bir y\u00f6ntemdir.<\/p>\n<p>Temel pek \u00e7ok konunun Bakanlar Kurulu\u2019nun yasa tasar\u0131lar\u0131 yerine yeterli incelemeden ge\u00e7memi\u015f yasa teklifleri veya son dakikada Meclis Genel Kurulu\u2019nda verilen de\u011fi\u015fiklik \u00f6nergeleriyle d\u00fczenlenmesinde de kat\u0131l\u0131mc\u0131 ve \u00e7o\u011fulcu demokrasi a\u00e7\u0131s\u0131ndan b\u00fcy\u00fck sorun vard\u0131r.<\/p>\n<p>Ayn\u0131 \u015fekilde Kanun H\u00fckm\u00fcnde Kararnamelerle yasamaya ait alana s\u00fcrekli tecav\u00fcz edilmesi, yaln\u0131zca TBMM\u2019yi devreden \u00e7\u0131karmakla kalmamakta, demokrasinin vazge\u00e7ilmezi olan muhalefeti etkisiz k\u0131lmak suretiyle kamuoyunun d\u00fczenlemelerden \u00f6nceden haberdar olmas\u0131n\u0131, s\u00fcrece kat\u0131lmas\u0131n\u0131 ve demokratik yollarla tepkisini ortaya koymas\u0131n\u0131 engellemektedir.<\/p>\n<p>Say\u0131n Cumhurba\u015fkan\u0131m,<\/p>\n<p>Bar\u0131\u015f veya a\u00e7\u0131l\u0131m olarak adland\u0131r\u0131lan bir s\u00fcre\u00e7 \u00f6n\u00fcm\u00fcze konuldu. Hi\u00e7 ku\u015fkusuz bir tek yurtta\u015f\u0131m\u0131z\u0131n bile burnunun kanamas\u0131n\u0131 arzu etmeyiz. Kan\u0131n durmas\u0131, ac\u0131lar\u0131n dinmesi, karde\u015flerin birbiriyle kucakla\u015fmas\u0131 en b\u00fcy\u00fck temennimizdir. Ancak s\u00fcrecin nas\u0131l y\u00fcr\u00fcd\u00fc\u011f\u00fcne, kiminle ve nas\u0131l m\u00fczakere edildi\u011fine, yol haritas\u0131n\u0131n duraklar\u0131na ve nihai hedefine ili\u015fkin sa\u011fl\u0131kl\u0131 bilgilere sahip de\u011filiz. Ama\u00e7, kan\u0131n durmas\u0131 ve toplumsal huzurun sa\u011flanmas\u0131 oldu\u011funa g\u00f6re, hepimiz i\u00e7in en b\u00fcy\u00fck felaket olacak bir i\u00e7 sava\u015f\u0131n tetiklenmesinden ortak akla ula\u015fmak suretiyle titizlikle ka\u00e7\u0131nmak zorunday\u0131z. Bunun i\u00e7in s\u00fcrecin \u015feffaf y\u00f6netilmesi ve geni\u015f tabanl\u0131 toplumsal mutabakat\u0131n sa\u011flanmas\u0131 zorunludur.<\/p>\n<p>Bu \u00e7er\u00e7evede, art\u0131k uluslararas\u0131 kurumlar\u0131n dahi yapt\u0131\u011f\u0131 tespitler kar\u015f\u0131s\u0131nda kamuoyunda inand\u0131r\u0131c\u0131l\u0131klar\u0131n\u0131 yitirmi\u015f olan, Balyoz, Ergenekon, Casusluk Davas\u0131 ve KCK gibi adlarla an\u0131lan ve adil yarg\u0131lanma hakk\u0131n\u0131n hi\u00e7e say\u0131ld\u0131\u011f\u0131 davalarda yaralanan toplumsal vicdan tamir edilmeden, toplumsal uzla\u015f\u0131ya ula\u015f\u0131lmas\u0131 m\u00fcmk\u00fcn de\u011fildir.<\/p>\n<p>Bug\u00fcn nas\u0131l Yass\u0131ada davalar\u0131n\u0131n travmas\u0131 hala devam ediyor ve Yass\u0131ada Mahkemesi\u2019nin hukuku hi\u00e7e sayan uygulamalar\u0131 T\u00fcrk Hukuk Tarihi\u2019nde kara birer leke olarak duruyorsa, an\u0131lan davalar da g\u00fcn\u00fcm\u00fcz\u00fcn gelece\u011fe b\u0131rakt\u0131\u011f\u0131 kara birer lekedir.<\/p>\n<p>K\u00fcrt sorunu, esasen demokrasi, \u00f6zg\u00fcrl\u00fckler ve insan haklar\u0131 sorunudur. Kal\u0131c\u0131 \u00e7\u00f6z\u00fcm, yaln\u0131zca anayasada de\u011fil uygulamada da e\u015fit yurtta\u015fl\u0131\u011f\u0131n sa\u011flanmas\u0131, ayr\u0131mc\u0131l\u0131\u011f\u0131n \u00f6nlenmesi ve ba\u015fka ayr\u0131mc\u0131l\u0131klara yol a\u00e7acak etnik temelli her t\u00fcrl\u00fc ayr\u0131cal\u0131ktan ka\u00e7\u0131n\u0131lmas\u0131 yoluyla sa\u011flanabilir. Hepimize d\u00fc\u015fen g\u00f6rev Ankara\u2019da, \u0130stanbul\u2019da, \u0130zmir\u2019de hangi insan hakk\u0131 i\u00e7in aya\u011fa kalk\u0131yorsak, \u015e\u0131rnak\u2019ta da, Diyarbak\u0131r\u2019da da, Lice\u2019de de, Uludere\u2019de de ayn\u0131 kararl\u0131l\u0131kla aya\u011fa kalkmakt\u0131r.<\/p>\n<p>Uzunca bir s\u00fcredir TBMM \u00e7at\u0131s\u0131 alt\u0131nda anayasa de\u011fi\u015fikli\u011fi i\u00e7in kapsaml\u0131 bir \u00e7al\u0131\u015fma y\u00fcr\u00fct\u00fclmektedir. Anayasa de\u011fi\u015fikli\u011finin amac\u0131 daha demokratik, daha \u00f6zg\u00fcr, hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fcn\u00fc benimsemi\u015f bir toplum ve devlet d\u00fczenine kavu\u015fmak olsa gerektir. Bu amaca ula\u015f\u0131labilmesi i\u00e7in anayasa de\u011fi\u015fikli\u011finden \u00f6nce \u00e7ok daha kolay at\u0131labilecek pek \u00e7ok ad\u0131m vard\u0131r. \u00d6rne\u011fin engizisyon d\u00f6nemlerini and\u0131ran gizli tan\u0131kl\u0131\u011f\u0131n kald\u0131r\u0131lmas\u0131, uygulamada tutuklama zorunlulu\u011fu alg\u0131s\u0131 yaratan katalog su\u00e7lara ili\u015fkin d\u00fczenlemeden vazge\u00e7ilmesi, Ter\u00f6rle M\u00fccadele Mahkemeleri\u2019nin la\u011fvedilmesi, Ter\u00f6rle M\u00fccadele Kanunu\u2019nun ilga edilmesi, d\u00fc\u015f\u00fcnce, d\u00fc\u015f\u00fcnceyi ifade, bas\u0131n \u00f6zg\u00fcrl\u00fc\u011f\u00fc ve toplant\u0131-g\u00f6steri \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn \u00f6n\u00fcndeki b\u00fct\u00fcn engellerin kald\u0131r\u0131lmas\u0131, bas\u0131nda tekelle\u015fmenin \u00f6nlenmesi, bas\u0131n emek\u00e7ilerinin \u00f6rg\u00fctlenmesinin sa\u011flanmas\u0131, Y\u00d6K\u2019\u00fcn kald\u0131r\u0131lmas\u0131, \u00fcniversitelerin idari ve mali \u00f6zerkli\u011fe, bilimsel \u00f6zg\u00fcrl\u00fc\u011fe kavu\u015fturulmas\u0131, %10 se\u00e7im baraj\u0131n\u0131n d\u00fc\u015f\u00fcr\u00fclmesi yol temizli\u011fi anlam\u0131nda akla gelenlerden yaln\u0131zca birka\u00e7\u0131d\u0131r. Bunlar yap\u0131lmadan herkesin \u00e7ekinmeden d\u00fc\u015f\u00fcncelerini ifade edebilece\u011fi ve bu d\u00fc\u015f\u00fcncelerini halka aktaracak kanallar\u0131 rahat\u00e7a bulabilece\u011fi bir tart\u0131\u015fma ortam\u0131 yarat\u0131lamaz. Oysa demokratik bir anayasa, en geni\u015f kat\u0131l\u0131mla olu\u015fturulabilir.<\/p>\n<p>Anayasa de\u011fi\u015fikli\u011fi tart\u0131\u015fmalar\u0131 s\u00fcrecinde g\u00fcndeme gelen ve ba\u015fkanl\u0131k sisteminin demokratik olmas\u0131n\u0131n vazge\u00e7ilmez ko\u015fulu olan denet ve denge mekanizmalar\u0131ndan ar\u0131nd\u0131r\u0131lm\u0131\u015f \u201cT\u00fcrk tipi ba\u015fkanl\u0131k sistemi\u201dnin, asl\u0131nda ba\u015fkanl\u0131k sistemi de\u011fil kuvvetler birli\u011fi esas\u0131na dayanan otoriter bir yap\u0131lanmay\u0131 hedefledi\u011fini tarihi sorumlulu\u011fumuzun gere\u011fi olarak burada ifade etmek durumunday\u0131m.<\/p>\n<p>Son olarak Cumhuriyetin temellerini olu\u015fturan ve Anayasa\u2019da g\u00fcvencesini bulan laiklik ve Atat\u00fcrk Milliyet\u00e7ili\u011fi konusundaki g\u00f6r\u00fc\u015flerimizi de burada payla\u015fmak istiyorum.<\/p>\n<p>Bug\u00fcn hem T\u00fcrkiye hem Ortado\u011fu, \u201cdin ve mezhep ayr\u0131mc\u0131l\u0131\u011f\u0131\u201d ve \u201c\u0131rk\u00e7\u0131l\u0131k\u201d olmak \u00fczere iki derin fay hatt\u0131 \u00fczerinde bulunmaktad\u0131r. Uyu\u015fmazl\u0131klar\u0131 de\u011fil, ortak menfaatleri \u00f6ne \u00e7\u0131karmal\u0131y\u0131z.<\/p>\n<p>Din d\u00fc\u015fmanl\u0131\u011f\u0131n\u0131 reddeden ancak bir dinin, mezhebin veya inanc\u0131n di\u011ferine tahakk\u00fcm\u00fcn\u00fc de kabul etmeyen; egemenli\u011fin ilahi de\u011fil, insana ve dolay\u0131s\u0131yla millete ait oldu\u011funu benimseyen laiklik anlay\u0131\u015f\u0131, demokrasinin, \u00f6zg\u00fcrl\u00fcklerin, k\u0131sacas\u0131 \u00f6zg\u00fcr ve g\u00fcvenli ya\u015faman\u0131n \u00f6n ko\u015fuludur.<\/p>\n<p>Hangi \u0131rktan, dinden, mezhepten, inan\u00e7tan, siyasi g\u00f6r\u00fc\u015ften geldi\u011fine bakmaks\u0131z\u0131n toplumda ya\u015fayan her bireyi e\u015fit yurtta\u015f olarak g\u00f6ren Atat\u00fcrk Milliyet\u00e7ili\u011fi ise b\u00f6l\u00fcnmenin, par\u00e7alanman\u0131n, yok olup gitmenin kar\u015f\u0131s\u0131ndaki yeg\u00e2ne dayanak noktas\u0131d\u0131r.<\/p>\n<p>Tarihten ders al\u0131n\u0131r ise, tarih tekerr\u00fcr etmez. Osmanl\u0131 \u0130mparatorlu\u011fu\u2019nu \u00e7ok hukukluluk ve her alanda bilimsel d\u00fc\u015f\u00fcnceden uzakla\u015fm\u0131\u015f olma \u00e7\u00f6kertmi\u015ftir. Ayr\u0131ca \u201cyurtta bar\u0131\u015f d\u00fcnyada bar\u0131\u015f\u201d ilkesinden vazge\u00e7ti\u011fimiz alg\u0131s\u0131ndan titizlikle ka\u00e7\u0131nmak, \u201cyeni Osmanl\u0131c\u0131l\u0131k\u201d gibi maceraperest yakla\u015f\u0131mlardan uzak durmakla y\u00fck\u00fcml\u00fcy\u00fcz.<\/p>\n<p>\u201cYurtta bar\u0131\u015f\u201d i\u00e7in, her yurtta\u015f\u0131m\u0131z\u0131n \u201ce\u015fit yurtta\u015f\u201d oldu\u011funu asla unutmamal\u0131y\u0131z. Hi\u00e7bir yurtta\u015f\u0131m\u0131z\u0131n, etnik k\u00f6keni, mezhebi, dini, inanc\u0131, dili, cinsiyeti, rengi y\u00fcz\u00fcnden ayr\u0131mc\u0131l\u0131\u011fa u\u011framas\u0131na asla izin vermemeliyiz. Ayn\u0131 \u015fekilde, siyasi d\u00fc\u015f\u00fcncesi sebebiyle yurtta\u015flar\u0131m\u0131z\u0131 \u201cbenden \u2013 senden\u201d diye farkl\u0131 gruplara veya y\u00fczdelere ay\u0131rmamal\u0131y\u0131z. Devletin kurum ve kurulu\u015flar\u0131n\u0131n, baz\u0131 yurtta\u015flara, siyasi d\u00fc\u015f\u00fcnceleri nedeniyle bask\u0131 uygulad\u0131\u011f\u0131, baz\u0131lar\u0131na ise ayr\u0131cal\u0131k tan\u0131d\u0131\u011f\u0131 alg\u0131s\u0131n\u0131 yaratacak, yurtta\u015flar\u0131n aras\u0131na kin ve nefret tohumlar\u0131 ekecek uygulamalara hep birlikte kar\u015f\u0131 \u00e7\u0131kmal\u0131y\u0131z.<\/p>\n<p>T\u00fcrkiye\u2019nin demokratikle\u015fme yolculu\u011funun sat\u0131r ba\u015flar\u0131n\u0131 iyi bilmeliyiz. \u00d6rne\u011fin g\u00f6zalt\u0131 s\u00fcrelerini uzatmak, polise g\u00f6zalt\u0131 yetkisi vermek gibi ge\u00e7mi\u015fin antidemokratik d\u00fczenlemelerine \u00f6yk\u00fcnmemeli, \u00e7\u00f6z\u00fcm\u00fc daima demokraside aramal\u0131y\u0131z. Polis devletini \u00e7a\u011fr\u0131\u015ft\u0131racak her t\u00fcrl\u00fc beyanattan, uygulamadan, d\u00fczenlemeden uzak durmal\u0131y\u0131z. Baz\u0131 yurtta\u015flar\u0131 di\u011fer baz\u0131 yurtta\u015flar\u0131n ihbarc\u0131s\u0131 yapacak, kom\u015fuyu kom\u015funun pe\u015fine d\u00fc\u015f\u00fcrecek \u00e7a\u011fr\u0131larda bulunmamal\u0131y\u0131z. Toplumsal dayan\u0131\u015fmay\u0131 yok edecek, muhbirli\u011fi \u00f6zendirecek \u201cs\u0131rda\u015f polis noktas\u0131\u201d gibi otoriter ve totaliter rejimlere \u00f6zg\u00fc projeler geli\u015ftirmeye son vermeliyiz.<\/p>\n<p>Bilime, sanata, \u00f6zg\u00fcr d\u00fc\u015f\u00fcnce ortam\u0131na ve insan haklar\u0131n\u0131n evrensel \u00f6l\u00e7\u00fctlerine hem yurtta hem d\u00fcnyada sahip \u00e7\u0131kmal\u0131y\u0131z. Bu suretle T\u00fcrkiye Cumhuriyeti\u2019nin \u00e7a\u011fda\u015f devletler ailesinin lider \u00fclkesi olmas\u0131n\u0131 sa\u011flamal\u0131y\u0131z. Unutmamal\u0131y\u0131z ki T\u00fcrkiye\u2019nin birka\u00e7 g\u00fcn sonra yap\u0131lacak olan G-20 zirvesinde d\u00fcnyan\u0131n \u00f6nemli ekonomilerinden biri s\u0131fat\u0131yla yer al\u0131yor olmas\u0131, \u00f6zg\u00fcr d\u00fc\u015f\u00fcncede, dolay\u0131s\u0131yla bilimde ve sanatta liderli\u011fe ula\u015fmad\u0131\u011f\u0131nda kal\u0131c\u0131 olmayacak; refah\u0131n hak\u00e7a da\u011f\u0131t\u0131m\u0131 ger\u00e7ekle\u015femeyecektir.<\/p>\n<p>Hem ekonomik hem siyasal istikrar\u0131n sa\u011flanabilmesi i\u00e7in demokrasiden, insan haklar\u0131ndan ve hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fcnden taviz vermememiz gerekti\u011fini bilmeliyiz. &#8220;\u00dcst\u00fcnlerin hukuku\u201dnun ge\u00e7erli k\u0131l\u0131nd\u0131\u011f\u0131 bir d\u00fczende, istikrardan s\u00f6z edilemeyece\u011fini, \u00e7\u00fcnk\u00fc b\u00f6yle bir d\u00fczende herkesin kaderinin siyasi iktidarlar\u0131n keyfine terk edildi\u011fini akl\u0131m\u0131zdan \u00e7\u0131karmamal\u0131y\u0131z.<\/p>\n<p>Elbette, d\u00fcnyan\u0131n neresinde zul\u00fcm varsa, Sudan\u2019da, Irak\u2019ta, Suriye\u2019de, M\u0131s\u0131r\u2019da zulm\u00fcn kar\u015f\u0131s\u0131nda, mazlumun yan\u0131nda samimiyetle durmal\u0131, zulme kar\u015f\u0131 \u00e7\u0131karken, her t\u00fcrl\u00fc siyasi hesaptan ka\u00e7\u0131nmal\u0131y\u0131z. Ancak bunu yaparken hem etkili olabilmek hem de Milletimizi maceralara s\u00fcr\u00fcklememek i\u00e7in d\u00fcnyay\u0131 kar\u015f\u0131m\u0131za almak yerine, yan\u0131m\u0131za almal\u0131, daima uluslararas\u0131 hukuk \u00e7er\u00e7evesinde kalmal\u0131y\u0131z.
