Bu nedenle Savc\u0131 Hasan Y\u00fcksel hakk\u0131ndaki incelemeyi Adalet Bakanl\u0131\u011f\u0131 Ceza \u0130\u015fleri Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc ba\u015flatt\u0131. Genel M\u00fcd\u00fcrl\u00fck yap\u0131lan inceleme sonucu, Y\u00fcksel hakk\u0131nda soru\u015fturma a\u00e7\u0131l\u0131p a\u00e7\u0131lmamas\u0131na karar verecek.<\/p>\n<p>HSYK&#8217;n\u0131n 18 Temmuz 2013 tarihli Adli Yarg\u0131 Kararnamesi ile Bor\u00e7ka Cumhuriyet Savc\u0131s\u0131 iken Bergama Cumhuriyet Savc\u0131l\u0131\u011f\u0131na atanan Y\u00fcksel, Ba\u015fsavc\u0131l\u0131\u011fa ge\u00e7ici vekalet ediyor.<\/p>\n<p>-&#8220;Cezas\u0131 yok&#8221;-<\/p>\n<p>Konuyu de\u011ferlediren \u0130stanbul \u00dcniversitesi Siyasal Bilgiler Fak\u00fcltesi \u00d6\u011fretim \u00dcyesi Prof. Dr. Ersan \u015een, Zafer Bayram\u0131 t\u00f6renlerinde m\u00fclki idare amiri, garnizon komutan\u0131 ve belediye ba\u015fkan\u0131n\u0131n kat\u0131l\u0131m\u0131n\u0131n zorunlu oldu\u011funu, o yerin savc\u0131s\u0131n\u0131n t\u00f6rende bulunma zorunlulu\u011fu olmad\u0131\u011f\u0131n\u0131 s\u00f6yledi.<\/p>\n<p>T\u00f6renlerde ba\u015fsavc\u0131 veya ba\u015fsavc\u0131 vekiline de nezaketen koltuk verildi\u011fini belirten \u015een, &#8220;T\u00f6renlerde bug\u00fcne kadar ki uygulama, bayrak ge\u00e7i\u015fi s\u0131ras\u0131nda aya\u011fa kalkmakt\u0131r, bayrak ge\u00e7ince protokoldekiler oturur, m\u00fclki idare amiri, garnizon komutan\u0131 ve belediye ba\u015fkan\u0131 ayakta kalmaya devam eder. Ama \u015fahs\u0131n yapt\u0131\u011f\u0131 sayg\u0131s\u0131zl\u0131k, yap\u0131lmamas\u0131 gerekir&#8221; dedi.<\/p>\n<p>Savc\u0131ya aya\u011fa kalkmad\u0131\u011f\u0131 i\u00e7in &#8220;bayra\u011fa sayg\u0131s\u0131zl\u0131k&#8221; veya &#8220;bayra\u011fa hakaretten&#8221; ceza verilemeyece\u011fini savunan \u015een, &#8220;Yaln\u0131zca etik a\u00e7\u0131dan dikkatini \u00e7ekerler. \u00c7\u00fcnk\u00fc, savc\u0131n\u0131n orada bulunmak zorunda de\u011fil. Bulunmas\u0131nda yasal bir zorunluluk yok ama \u00f6yle bir team\u00fcl olu\u015fmu\u015f. Bunun bir adli cezas\u0131 yok, sayg\u0131 \u00e7er\u00e7evesinde de\u011ferledirilir.
