An\u0131lan Kurulun 28.11.2006 g\u00fcnl\u00fc, 2117-2 say\u0131l\u0131 karar\u0131na g\u00f6re de\u011fi\u015fiklik yap\u0131larak \u00d6zelle\u015ftirme Y\u00fcksek Kurulunun yarg\u0131ya ta\u015f\u0131nm\u0131\u015f bulunan 27.12.2006 g\u00fcnl\u00fc, 2006\/104 say\u0131l\u0131 karar\u0131yla 1\/5000 \u00f6l\u00e7ekli Be\u015fikta\u015f-Ortak\u00f6y koruma ama\u00e7l\u0131 naz\u0131m imar plan\u0131 1\/1000 \u00f6l\u00e7ekli uygulama imar plan\u0131 de\u011fi\u015fikli\u011fi ger\u00e7ekle\u015ftirilmi\u015ftir.<\/p>\n<p>Bo\u011fazi\u00e7i etkilenme b\u00f6lgesinin, metropoliten kentsel geli\u015fmeden, Bo\u011fazi\u00e7i alan\u0131na ge\u00e7i\u015f b\u00f6lgesi olarak say\u0131lan Ortak\u00f6y vadisinin, metropoliten kentsel alan ile bulu\u015ftu\u011fu ta\u00e7 noktas\u0131ndaki tampon b\u00f6lgede yer alan, Bo\u011fazi\u00e7i alan\u0131na ait \u00f6zellikleri ta\u015f\u0131mas\u0131 ve vadi ye\u015fil alanlar b\u00fct\u00fcnselli\u011finin ve co\u011frafi, do\u011fal yap\u0131 s\u00fcreklili\u011finin korunmas\u0131 gereken bir alanda, \u0130stanbul Bo\u011fazi\u00e7i Alan\u0131n\u0131n k\u00fclt\u00fcrel ve tarihi de\u011ferlerini ve do\u011fal g\u00fczelliklerini kamu yarar\u0131 g\u00f6zetilerek korumak, geli\u015ftirmek; bu alandaki n\u00fcfus yo\u011funlu\u011funu art\u0131racak yap\u0131lanmay\u0131 s\u0131n\u0131rlamak i\u00e7in uygulanacak imar mevzuat\u0131n\u0131 belirlemek ve d\u00fczenlemek amac\u0131yla \u00e7\u0131kar\u0131lm\u0131\u015f bulunan 2960 say\u0131l\u0131 Bo\u011fazi\u00e7i Kanunu kapsam\u0131nda, Bo\u011fazi\u00e7i Alan\u0131nda ve Etkilenme B\u00f6lgesinde kalan bir ta\u015f\u0131nmaz \u00fczerinde ancak Taban Alan\u0131 Kat Say\u0131s\u0131 (T.A.K.S.) % 15 ve 5 kat\u0131 (H = 15.50 m. irtifa\u0131) ge\u00e7memek \u015fart\u0131 ile konut yap\u0131labilece\u011fi a\u00e7\u0131kt\u0131r.<\/p>\n<p>Ancak, t\u00fcm \u015fehircilik ilkelerine, planlama esaslar\u0131na ve kamu yarar\u0131na ayk\u0131r\u0131 olarak yap\u0131lan parsel baz\u0131ndaki plan de\u011fi\u015fikleri ile planlama alan\u0131 2.80 emsalle, &#8220;Turizm Kongre Merkezi, Ticaret ve K\u00fclt\u00fcrel Tesis \u201d fonksiyonlar\u0131na ayr\u0131lm\u0131\u015f ve plan notlar\u0131 ile, Turizm Kongre Merkezi, Ticaret ve K\u00fclt\u00fcrel Tesis alan\u0131nda, ticaret alan\u0131 (i\u015f ve al\u0131\u015fveri\u015f merkezleri, ticari b\u00fcro kullan\u0131mlar\u0131, sergi ve sat\u0131\u015f tesisleri, toptan ve perakende ticaret) tesisleri, y\u00f6netim merkezleri (ofis-b\u00fcro), sosyo- k\u00fclt\u00fcrel tesisler, her t\u00fcrl\u00fc turizm tesisleri, kongre merkezi ve rezidans yap\u0131lmas\u0131na olanak sa\u011flam\u0131\u015f yap\u0131lardaki maksimum y\u00fcksekli\u011fin tescilli idari blok binas\u0131ndan uzakl\u0131k ile ba\u011flant\u0131l\u0131 olarak bu binan\u0131n 1,5 -2 misli y\u00fcksekli\u011fini a\u015famayaca\u011f\u0131 gibi bilimsel olmayan k\u0131s\u0131tlamayla planlama alan\u0131ndaki toplam in\u015faat alan\u0131n\u0131n % 15\u2019i ticaret, % 10\u2019u y\u00f6netim (ofis-b\u00fcro); % 10\u2019u sosyo-k\u00fclt\u00fcrel ve %35\u2019i rezidansa (konut alan\u0131) ayr\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>\u00d6zelle\u015ftirme \u0130daresi elinde ko\u015fullu olarak bulundurdu\u011fu planlama yetkisini de a\u015farak, her t\u00fcrl\u00fc imar ve \u015fehircilik kural ve kuram\u0131 \u00f6tesinde planlamada e\u015fitlik ve adalet ilkesine de ayk\u0131r\u0131 olarak arsa spek\u00fclasyonu amac\u0131yla kullanm\u0131\u015f, bir anlamda, son derece \u00f6zel koruma ko\u015fullar\u0131nda bulanan kamu arazisi ile birlikte imar haklar\u0131n\u0131 da a\u00e7\u0131k artt\u0131rmayla sat\u0131\u015fa \u00e7\u0131karm\u0131\u015ft\u0131r.<\/p>\n<p>B\u00f6ylelikle kamu yarar\u0131n\u0131 ger\u00e7ekle\u015ftirmek, y\u00f6re halk\u0131n\u0131n sa\u011fl\u0131\u011f\u0131n\u0131 ve \u00e7evreyi korumak, sosyal ve k\u00fclt\u00fcrel ihtiya\u00e7lar\u0131n\u0131, iyi ya\u015fama d\u00fczenini, \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131 ve g\u00fcvenli\u011fini, o \u00e7evrede ya\u015fayan halk\u0131n yerel ortak gereksinimlerini sa\u011flamak amac\u0131yla \u00fcretilmesi gereken birer belge niteli\u011finde olan imar plan\u0131; 84.064.20 m2 lik bir alan\u0131n yakla\u015f\u0131k 56.000 m 2 sini betonla\u015ft\u0131rarak ge\u00e7irimsiz hale getiren ve 393.330 m2si emsal d\u0131\u015f\u0131, 215.559m2 si konut kullan\u0131\u015f\u0131 olmak \u00fczere toplam 628.709.26m2 yap\u0131 alanl\u0131 ve sadece kapal\u0131 otoparklar\u0131na 3.145 adet ara\u00e7 \u00e7a\u011f\u0131ran devasa bir yap\u0131 k\u00fctlesinin ortaya \u00e7\u0131kmas\u0131na neden olan bir spek\u00fclasyon arac\u0131 haline getirilmi\u015ftir.<\/p>\n<p>\u0130stanbul\u2019un e\u015fsiz topografyas\u0131n\u0131n simgeleri olan ve yo\u011fun bir yap\u0131la\u015fma ve betonla\u015fma sonucunda temiz hava solunmas\u0131na engel olan egzoz ve sera gazlar\u0131n\u0131 ya\u015fam alanlar\u0131m\u0131zdan uzakla\u015ft\u0131ran, do\u011fal havaland\u0131rma bacalar\u0131 olarak, kentin klimatik konforunu ve y\u00fczde doksanlara varan nem ve kentsel sellere neden olan bozulan kentsel iklim dengesini sa\u011flayabilme \u00f6zellikleri nedeni ile dahi korunmas\u0131; gelecek ku\u015faklar ve bizler i\u00e7in evrensel ve hayati bir \u00f6nem ta\u015f\u0131yorken;<\/p>\n<p>Son derece sorumsuzca ve k\u0131sa vadeli ekonomik \u00e7\u0131karlar do\u011frultusunda, teknik ve bilimsel ger\u00e7eklere uyulmadan al\u0131nm\u0131\u015f plan kararlar\u0131 ile; \u0130stanbul\u2019un tamam\u0131n\u0131 b\u00fcy\u00fck bir saks\u0131ya \u00e7evirip; parsellerin tamam\u0131n da kentsel topra\u011f\u0131 yok ederek; ya\u015fam\u0131n en \u00f6nemli kaynaklar\u0131ndan olan toprak ve suyun bulu\u015fmas\u0131n\u0131n \u00f6nleyip; yok edilen do\u011fan\u0131n ekolojik dengesini; betonla\u015ft\u0131r\u0131lan alanlarda yap\u0131lacak mimari eserlerin \u00e7at\u0131lar\u0131na ta\u015f\u0131nacak 30 ila 40 cm.lik bitkisel topraktan ve k\u00f6k salmas\u0131na izin verilmeyecek a\u011fa\u00e7lardan beklemek;
