Mahkeme gerek\u00e7e olarak Yarg\u0131tay\u2019\u0131n bozma ilam\u0131nda da a\u00e7\u0131k\u00e7a vurgulad\u0131\u011f\u0131 gibi mahkemenin g\u00f6revsiz oldu\u011funun ortada oldu\u011funu belirterek, “Dosyada yap\u0131labilecek t\u00fcm tart\u0131\u015fmalar\u0131n ve gerekirse delillerin de\u011ferlendirilmesinin y\u00fcksek g\u00f6revli mahkemece yap\u0131lmas\u0131n\u0131n uygun olaca\u011f\u0131 her t\u00fcrl\u00fc izahtan \u00f6tedir.
