HSYK Ba\u015fkanvekili Kadir \u00d6zbek ise t\u00f6ren ba\u015f\u0131nda salondan \u00e7\u0131kt\u0131.<\/p>\n<p>S\u00f6zlerine, &#8220;Devletin Anayasa ile yetki, g\u00f6rev ve sorumluluklar\u0131 belirlenmi\u015f \u00fc\u00e7 ana erki yasama, y\u00fcr\u00fctme ve yarg\u0131 aras\u0131ndaki \u00e7at\u0131\u015fmalar\u0131n sona ermesi, Anayasan\u0131n \u00f6ng\u00f6rd\u00fc\u011f\u00fc \u00e7izgide, demokratik, laik, sosyal hukuk devletinin t\u00fcm \u00f6l\u00e7\u00fctleri ile ya\u015fama ge\u00e7mesi, toplumun t\u00fcm bireyleri ve kurumlar aras\u0131nda, bar\u0131\u015f, karde\u015flik, huzur, g\u00fcven, kar\u015f\u0131l\u0131kl\u0131<\/p>\n<p>sevgi ve sayg\u0131 ortam\u0131n\u0131n ger\u00e7ekle\u015fmesi, sorunlar\u0131n \u00e7\u00f6z\u00fcm\u00fcnde, kar\u015f\u0131t g\u00f6r\u00fc\u015fler ortaya konulurken, hakarete, as\u0131ls\u0131z isnatlara, iftiraya varmayacak \u015fekilde, demokrasinin gere\u011fi olan ve ona uygun bir tart\u0131\u015fma ortam\u0131n\u0131n olu\u015fmas\u0131&#8221; dile\u011fiyle ba\u015flayan Ger\u00e7eker, yarg\u0131daki sorunlar\u0131n b\u00fcy\u00fck \u00f6l\u00e7\u00fcde devam etti\u011fini s\u00f6yledi.<\/p>\n<p>Anayasa de\u011fi\u015fikli\u011fine gerek yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131na gerekse kuvvetler ayr\u0131l\u0131\u011f\u0131 ilkesine, dolay\u0131s\u0131 ile hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fc, hukuk devleti ilkelerine ayk\u0131r\u0131 oldu\u011fu d\u00fc\u015f\u00fcncesi ile gerek ki\u015fisel gerekse kurumsal olarak kar\u015f\u0131 \u00e7\u0131kt\u0131klar\u0131n\u0131 vurgulayan Ger\u00e7eker, ba\u011f\u0131ms\u0131z olmayan bir yarg\u0131n\u0131n siyasalla\u015faca\u011f\u0131n\u0131 ve tarafs\u0131zl\u0131\u011f\u0131n\u0131 yitirece\u011fini, bunun da bir toplum i\u00e7in en b\u00fcy\u00fck tehlike oldu\u011funu ifade etti.<\/p>\n<p>&#8220;HSYK&#8217;DAK\u0130 D\u00dcZENLEME YARGI BA\u011eIMSIZLI\u011eINA AYKIRI&#8221;<\/p>\n<p>Yeni d\u00fczenlemede Anayasa Mahkemesi&#8217;nin mevcut \u00fcye say\u0131s\u0131n\u0131n \u00e7o\u011falt\u0131lmas\u0131 yerinde ise de \u00fcyelerinin tamam\u0131n\u0131n y\u00fcr\u00fctmenin ba\u015f\u0131 olan Cumhurba\u015fkan\u0131 ve Parlamentonun salt \u00e7o\u011funlu\u011fu ile se\u00e7ilmesinin Y\u00fcksek Yarg\u0131 organlar\u0131n\u0131n (Yarg\u0131tay, Dan\u0131\u015ftay, Askeri Yarg\u0131tay) \u00e7o\u011falt\u0131lan \u00fcye say\u0131s\u0131na g\u00f6re etkinli\u011finin azalt\u0131lmas\u0131, kuvvetler ayr\u0131l\u0131\u011f\u0131 ilkesine ayk\u0131r\u0131 oldu\u011fu gibi, bu \u015fekilde bir d\u00fczenlemenin Anayasa Mahkemesi&#8217;nin tamamen y\u00fcr\u00fctmenin etki alan\u0131na girmesine neden olaca\u011f\u0131n\u0131 ve beraberinde de b\u00fcy\u00fck \u00f6l\u00e7\u00fcde siyasalla\u015fma ele\u015ftirilerini getirece\u011fini savunan Ger\u00e7eker, ayn\u0131 \u015fekilde H\u00e2kimler ve Savc\u0131lar Y\u00fcksek Kurulu&#8217;nun (HSYK) yap\u0131s\u0131 ile ilgili olarak da kuvvetler ayr\u0131l\u0131\u011f\u0131 ve yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131na ayk\u0131r\u0131 bir d\u00fczenleme s\u00f6z konusu oldu\u011funu ileri s\u00fcrd\u00fc.<\/p>\n<p>Ger\u00e7eker, \u015f\u00f6yle devam etti: &#8220;H\u00e2kim ve savc\u0131lar\u0131 mesle\u011fe kabul etme, atama, nakletme, ge\u00e7ici yetki verme, y\u00fckseltme, birinci s\u0131n\u0131fa ay\u0131rma, kadro da\u011f\u0131tma, g\u00f6revden uzakla\u015ft\u0131rma i\u015flemleri bak\u0131m\u0131ndan tam yetkili olan Kurul&#8217;a Y\u00fcr\u00fctmenin temsilcisi olan Adalet Bakan\u0131&#8217;n\u0131n geni\u015f yetkilerle ba\u015fkanl\u0131k etmesi, her ne kadar h\u00e2kim s\u0131n\u0131f\u0131ndan olsa da, konumu itibariyle y\u00fcr\u00fctme erkinin i\u00e7inde bulunan M\u00fcste\u015far\u0131n\u0131n kurulun do\u011fal \u00fcyesi olmas\u0131 kuvvetler ayr\u0131l\u0131\u011f\u0131 ve yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131 ilkeleri ile ba\u011fda\u015fmamaktad\u0131r. Adalet Bakan\u0131 ve M\u00fcste\u015far\u0131&#8217;n\u0131n Kurul&#8217;da yer almas\u0131n\u0131n demokratik me\u015fruiyet ilkesi ile a\u00e7\u0131klanmas\u0131 da ger\u00e7e\u011fi yans\u0131tmamaktad\u0131r. Mevcut ve yasal bir \u00fcst mahkeme olgusu ve i\u015fleyi\u015finin, h\u00e2kim ve savc\u0131lar\u0131n yarg\u0131sal faaliyetleri \u00fczerindeki nesnel etkisinin vesayet izlenimi bi\u00e7iminde tan\u0131mlanmas\u0131 \u015fa\u015f\u0131rt\u0131c\u0131 ve iyi niyetten uzak bir yakla\u015f\u0131md\u0131r. Bu izlenimin ne \u015fekilde ortaya \u00e7\u0131kt\u0131\u011f\u0131, bu \u015fekilde bir g\u00f6rev fonksiyonunun yarg\u0131n\u0131n i\u015fleyi\u015finde ne gibi bir sorun olu\u015fturdu\u011fu a\u00e7\u0131kl\u0131kla ortaya konulmu\u015f de\u011fildir. H\u00e2kimler ve Savc\u0131lar Y\u00fcksek Kurulu&#8217;nun daha verimli ve etkin \u00e7al\u0131\u015fmas\u0131n\u0131n \u00f6n\u00fcndeki temel sorun ba\u015fkad\u0131r. Adalet Bakan\u0131 ve M\u00fcste\u015far\u0131&#8217;n\u0131n Kurul&#8217;da bulunmas\u0131, Kurul \u00e7al\u0131\u015fmalar\u0131n\u0131n istikrarl\u0131 bir \u015fekilde s\u00fcrmesini engelledi\u011fi gibi, yap\u0131lmak istenilen d\u00fczenleme ger\u00e7ekle\u015fti\u011fi takdirde, bu karma ve yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131na ayk\u0131r\u0131 yap\u0131, Kurul&#8217;u \u00e7al\u0131\u015famaz hale getirecektir.&#8221;<\/p>\n<p>\u00d6RG\u00dcTLENME \u00d6ZG\u00dcRL\u00dc\u011e\u00dc ENGELLENEMEZ<\/p>\n<p>G\u00f6zlemin ki\u015fiye g\u00f6re de\u011fi\u015fen s\u00fcbjektif bir kavram oldu\u011funu dile getiren Ger\u00e7eker, hal k\u00e2\u011f\u0131d\u0131n\u0131 d\u00fczenleyen m\u00fcfetti\u015fin ki\u015fisel do\u011frular\u0131 ve ki\u015fisel de\u011ferlerine g\u00f6re yapaca\u011f\u0131 g\u00f6zlem sonucu d\u00fczenleyece\u011fi hal k\u00e2\u011f\u0131d\u0131n\u0131n her zaman objektif olabilece\u011finden s\u00f6z etmenin m\u00fcmk\u00fcn olmad\u0131\u011f\u0131n\u0131 kaydetti. Bu nedenle denetimlerin keyfilikten uzak olmas\u0131n\u0131n mutlaka sa\u011flanmas\u0131 gerekti\u011fini vurgulayan Ger\u00e7eker, bu belgelerin ilgili h\u00e2kim ve savc\u0131ya tebli\u011f edilerek, de\u011ferlendirmenin as\u0131l \u00f6znesi konumunda bulunan bu ki\u015filere cevap ve itiraz hakk\u0131 tan\u0131nmas\u0131n\u0131 istedi.<\/p>\n<p>Ba\u015fbakan Erdo\u011fan&#8217;\u0131n YARSAV ba\u015fta olmak \u00fczere yarg\u0131daki \u00f6rg\u00fctlenmeyi ele\u015ftirmesine de cevap veren Ger\u00e7eker, &#8220;\u00d6rg\u00fctlenme \u00f6zg\u00fcrl\u00fc\u011f\u00fc, t\u00fcm \u00e7a\u011fda\u015f demokratik sistemi benimsemi\u015f \u00fclkelerde oldu\u011fu gibi demokratik temel hak ve \u00f6zg\u00fcrl\u00fckler kapsam\u0131nda kabul edilmi\u015f ve uluslararas\u0131 s\u00f6zle\u015fmelerle de g\u00fcvence alt\u0131na al\u0131nm\u0131\u015ft\u0131r. \u00d6rg\u00fctlenme \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc engelleyerek, y\u00fcr\u00fctmenin g\u00fcd\u00fcm\u00fcnde, ama\u00e7 d\u0131\u015f\u0131, g\u00f6stermelik bir \u00f6rg\u00fctlenme modeli olu\u015fturma \u00e7abalar\u0131ndan vazge\u00e7ilmelidir.&#8221; diye konu\u015ftu.<\/p>\n<p>Hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fc ile yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131 aras\u0131ndaki ba\u011f\u0131n \u00e7ok \u00f6nemli oldu\u011funu vurgulayan Ger\u00e7eker, hukuk \u00fcst\u00fcn tutuluyorsa, yarg\u0131n\u0131n ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131n mutlak olarak sa\u011flanmas\u0131 gerekti\u011fini belirtti.<\/p>\n<p>Hukukun ayak ba\u011f\u0131 olarak g\u00f6r\u00fclmesi halinde yarg\u0131n\u0131n mutlaka bask\u0131 alt\u0131nda olaca\u011f\u0131n\u0131 savunan Ger\u00e7eker, &#8220;Yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131, yarg\u0131 tarafs\u0131zl\u0131\u011f\u0131n\u0131n da en temel ko\u015fuludur. Yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131 hi\u00e7 \u015f\u00fcphe yok ki tarafs\u0131zl\u0131\u011f\u0131 da i\u00e7ermektedir. Yarg\u0131n\u0131n tarafs\u0131zl\u0131\u011f\u0131 konusunda, devam eden soru\u015fturma ve kovu\u015fturmalarla ilgili olarak, basta medya olmak \u00fczere her kesimin Hassasiyet g\u00f6stermesi, masumiyet ilkesinin ihlal edilmemesi, yarg\u0131s\u0131z infaz anlam\u0131na gelebilecek davran\u0131\u015flardan mutlaka ka\u00e7\u0131n\u0131lmas\u0131 gerekmektedir.&#8221; \u015feklinde konu\u015ftu.<\/p>\n<p>&#8220;YARGI ELE\u015eT\u0130R\u0130LEB\u0130L\u0130R&#8221;<\/p>\n<p>Yarg\u0131n\u0131n da ele\u015ftirilebilece\u011fini dile getiren Ger\u00e7eker, \u015funlar\u0131 s\u00f6yledi: &#8220;Yarg\u0131 ile ilgili haber niteli\u011finin \u00f6tesinde yorum yap\u0131l\u0131rken bu ayr\u0131m\u0131n g\u00f6zetilmesi ve \u00e7ok \u00f6zen g\u00f6sterilmesi gerekmektedir. Ger\u00e7eklere dayan\u0131lmal\u0131, verilen haberin do\u011frulu\u011fu ispatlanabilmelidir. Yanl\u0131\u015f ya da eksik bilgilerle yap\u0131lan haber ve yorumlar, y\u00f6nlendirici yay\u0131nlar, kamuoyunu yanl\u0131\u015f y\u00f6nde etkileyece\u011fi gibi, mahkemeler \u00fczerinde bir bask\u0131 unsuru da olu\u015fturacakt\u0131r.&#8221;<\/p>\n<p>Avrupa \u0130nsan Haklar\u0131 Mahkemesi(A\u0130HM)&#8217;nde de T\u00fcrkiye y\u00f6n\u00fcnden en s\u0131k\u0131nt\u0131l\u0131 konulardan birisi haline gelmi\u015f bulunan tutukluluk s\u00fcrelerinin adeta yarg\u0131s\u0131z infaz say\u0131labilecek derecede uzamas\u0131n\u0131n bu konuda yasal ve yeterli gerek\u00e7e g\u00f6sterilmeden karar verilmesinin, yasal olmayan ya da yasayla \u00f6ng\u00f6r\u00fclen ko\u015fullara tam olarak uyulmadan yap\u0131lan ileti\u015fimin tespiti, dinlenmesi ve kayda al\u0131nmas\u0131 gibi temel hak ve \u00f6zg\u00fcrl\u00fcklerle do\u011frudan ili\u015fkili usule ayk\u0131r\u0131 i\u015flemlerde yarg\u0131ya olan g\u00fcveni b\u00fcy\u00fck \u00f6l\u00e7\u00fcde zedeledi\u011fini vurgulayan Ger\u00e7eker, Adalet Bakan\u0131&#8217;n\u0131n Meclis&#8217;te a\u00e7\u0131klad\u0131\u011f\u0131 verileri hat\u0131rlatarak, a\u00e7\u0131klamay\u0131 yapan\u0131n, bu sorunlar\u0131 \u00e7\u00f6zmekle birinci derecede y\u00fck\u00fcml\u00fc Adalet Bakan\u0131 olmas\u0131 kars\u0131s\u0131nda, durumun ne kadar vahim oldu\u011funun ortada oldu\u011funu ileri s\u00fcrd\u00fc.<\/p>\n<p>Yarg\u0131 reformunun elbette gerekli oldu\u011funu ve mutlaka acilen de yap\u0131lmas\u0131n\u0131 isteyen Ger\u00e7eker, ancak reformun yarg\u0131n\u0131n bu g\u00fcn b\u00fcy\u00fck boyutlara ula\u015fm\u0131\u015f bulunan alt yap\u0131 sorunlar\u0131n\u0131n \u00e7\u00f6z\u00fcmlenmesinden ba\u015flanmas\u0131 gerekti\u011fini s\u00f6yledi.<\/p>\n<p>&#8220;B\u0130REYSEL BA\u015eVURU VER\u0130LEN KARARLARI DE\u011e\u0130\u015eT\u0130R\u0130R&#8221;<\/p>\n<p>Bireysel ba\u015fvuru ile temel insan hak ve \u00f6zg\u00fcrl\u00fcklerinin olay baz\u0131nda belirlenmesi, ihlal edilen hakk\u0131n onar\u0131lmas\u0131 ve gerekli \u00f6nlemlerin al\u0131nmas\u0131 i\u00e7in bu yetkinin Anayasa Mahkemesine verilmek istendi\u011fini hat\u0131rlatan Ger\u00e7eker, \u015f\u00f6yle devam etti: &#8220;Ancak, bu yetki ile y\u00fcksek mahkemelerden verilen kararlar\u0131n de\u011fi\u015ftirilmesi ya da ortadan kald\u0131r\u0131lmas\u0131 gibi bir sonu\u00e7 ortaya \u00e7\u0131kacakt\u0131r. Zira iddia edilen ihlalin onar\u0131lmas\u0131 ve \u00f6nlenmesinin ba\u015fka t\u00fcrl\u00fc yerine getirilmesi olanaks\u0131zd\u0131r. Bu durumda da yap\u0131lmak istenen d\u00fczenleme, y\u00fcksek mahkeme kararlar\u0131n\u0131n denetlenmesi ve yeniden bir karar olu\u015fturulmas\u0131 sonucunu do\u011furacakt\u0131r. \u00dclkemizde y\u00fcksek mahkemelerin g\u00f6revleri ve i\u015flevleri Anayasa ile kurulu\u015f kanunlar\u0131nda belirtilmi\u015ftir. Hi\u00e7bir y\u00fcksek mahkeme di\u011ferinin karar\u0131n\u0131 ortadan kald\u0131ramaz, de\u011fi\u015ftiremez ve karar\u0131 uygulanamaz hale getiremez. Y\u00fcksek mahkemelerin denkli\u011fi esast\u0131r. Bu denkli\u011fin bozulmas\u0131 yarg\u0131da kaos yarat\u0131r, y\u00fcksek mahkemelerin \u00e7at\u0131\u015fmas\u0131 sonucunu do\u011furur. Yarar yerine zarar getirir.&#8221;<\/p>\n<p>Vatanda\u015flar\u0131n \u015fik\u00e2yetleri, s\u0131zlanmalar\u0131, yak\u0131nmalar\u0131n\u0131n g\u00fcnden g\u00fcne artt\u0131\u011f\u0131na dikkat \u00e7eken Ger\u00e7eker, adaletin bir an \u00f6nce ger\u00e7ekle\u015fmesini bekleyen bu ki\u015filere sorunlar\u0131 mazeret olarak g\u00f6stermelerinin m\u00fcmk\u00fcn olmad\u0131\u011f\u0131n\u0131 kaydetti.<\/p>\n<p>&#8220;HALKIN EGEMENL\u0130\u011e\u0130 HER ZAMAN HALKIN \u00d6ZG\u00dcRL\u00dc\u011e\u00dc DE\u011e\u0130LD\u0130R&#8221;<\/p>\n<p>Vatandas\u0131n devletten, yetkililerden bekledi\u011fi bu sorunlar\u0131n bir an \u00f6nce \u00e7\u00f6z\u00fcme kavu\u015fturulmas\u0131 oldu\u011funu vurgulayan Ger\u00e7eker, Montesquieu&#8217;nun s\u00f6z\u00fcyle h\u00fck\u00fcmete y\u00fcklendi: &#8220;\u00d6zg\u00fcrl\u00fck yasalar taraf\u0131ndan yasak edilmeyeni yapabilmektir. Siyasal iktidar\u0131 ele ge\u00e7irenler i\u00e7g\u00fcd\u00fcsel olarak bu g\u00fc\u00e7lerini s\u00fcrd\u00fcrmek isterler. Bu nedenle de \u00f6n\u00fcnde engel bulunmazsa her siyasal y\u00f6neticinin \u00f6zg\u00fcrl\u00fckleri \u00f6nemsemeyece\u011fini, yetkilerini asabilece\u011fini, bu konuda s\u0131n\u0131r tan\u0131mayaca\u011f\u0131n\u0131, bunun \u00e7ok say\u0131da tarihsel \u00f6rneklerinin bulundu\u011funu s\u00f6ylemektedir. G\u00fcc\u00fcn s\u0131n\u0131rlanmas\u0131 i\u00e7in kuvvetler ayr\u0131l\u0131\u011f\u0131n\u0131n gerekti\u011fini, yasama, y\u00fcr\u00fctme ve yarg\u0131 olarak bu \u00fc\u00e7 ayr\u0131 g\u00fcc\u00fcn birbirleri ile uyum i\u00e7inde \u00e7al\u0131\u015farak genel dengeyi sa\u011flayacaklar\u0131n\u0131 belirtmektedir. Anayasa hukukunun ve siyaset biliminin temel kural\u0131 Halk\u0131n egemenli\u011fi, her zaman halk\u0131n \u00f6zg\u00fcrl\u00fc\u011f\u00fc demek de\u011fildir. \u00c7o\u011funlu\u011fun bask\u0131s\u0131n\u0131n oldu\u011fu yerde \u00f6zg\u00fcrl\u00fckten s\u00f6z edilemez. Sonu\u00e7ta, demokrasi zedelenir, \u00f6zg\u00fcrl\u00fckler ortadan kalkar. Bug\u00fcn siyaset bilimi ve anayasal demokrasi a\u00e7\u0131s\u0131ndan parlamenter sisteme getirilen en \u00f6nemli ele\u015ftiri, iktidara gelen partinin bu \u00fc\u00e7 kuvvet \u00fczerinde de etkinli\u011fini artt\u0131rmak istemesidir. T\u00fcrkiye&#8217;de uygulanan se\u00e7im sistemi itibariyle siyasal g\u00fcc\u00fc elinde tutan h\u00fck\u00fcmet ba\u015fkan\u0131, ba\u015fbakan, hem y\u00fcr\u00fctme hem de TBMM&#8217;ndeki iktidar grubunun ba\u015fkan\u0131 olarak bu iki kuvvet (y\u00fcr\u00fctme ve yasama) \u00fczerindeki etkinli\u011fini s\u00fcrd\u00fcrmektedir.&#8221;<\/p>\n<p>&#8220;YARGI Y\u00dcR\u00dcTMEN\u0130N ETK\u0130 ALANINA SOKULMAK \u0130STEN\u0130YOR&#8221;<\/p>\n<p>Yap\u0131lmak istenilen anayasa de\u011fi\u015fiklikleri ile Anayasa Mahkemesi ve H\u00e2kimler Savc\u0131lar Y\u00fcksek Kurulu&#8217;nun yap\u0131s\u0131 de\u011fi\u015ftirilerek; buralara yap\u0131lacak atamalarda ve bu kurumlar\u0131n isleyi\u015finde y\u00fcr\u00fctmenin etkinli\u011fi \u00e7o\u011falt\u0131lmak suretiyle, yarg\u0131n\u0131n tamamen y\u00fcr\u00fctmenin etki alan\u0131nda bulundu\u011fu bir sistem getirilmek istendi\u011fini iddia eden Ger\u00e7eker, &#8220;Bu durum, kuvvetler ayr\u0131l\u0131\u011f\u0131 ilkesini tamamen ortadan kald\u0131rarak adeta kuvvetler birli\u011fine d\u00f6n\u00fc\u015f olacak, yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131 b\u00fcy\u00fck \u00f6l\u00e7\u00fcde ortadan kald\u0131racakt\u0131r. Siyasal iktidar\u0131n k\u00f6t\u00fcye kullan\u0131lmamas\u0131 ve \u00f6zg\u00fcrl\u00fck\u00e7\u00fc demokrasinin ger\u00e7ekle\u015febilmesi i\u00e7in kuvvetler ayr\u0131l\u0131\u011f\u0131 en bas ko\u015fuldur. Ba\u011f\u0131ms\u0131z yarg\u0131 istiyorsak, H\u00e2kimler ve Savc\u0131lar Y\u00fcksek Kurulunun yap\u0131s\u0131 bu bak\u0131mdan \u00e7ok b\u00fcy\u00fck \u00f6nem arz etmektedir. Ar\u0131zi bir tak\u0131m olaylar gerek\u00e7e g\u00f6sterilmek suretiyle, kuvvetler ayr\u0131l\u0131\u011f\u0131 ve yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131na ili\u015fkin temel ilkeler g\u00f6z ard\u0131 edilerek b\u00f6yle bir tak\u0131m d\u00fczenlemeler yap\u0131lmas\u0131, hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fc, hukuk devleti ilkelerini \u00e7ok b\u00fcy\u00fck \u00f6l\u00e7\u00fcde zedeleyecektir. Kurula yaln\u0131z yarg\u0131 mensuplar\u0131ndan \u00fcye se\u00e7ilmelidir. Kast gibi, j\u00fcristokrasi gibi, al g\u00fcl\u00fcm ver g\u00fcl\u00fcm gibi konu ile ilgisi olmayan kavramlar, hafif d\u00fc\u015f\u00fcnceler hi\u00e7bir ge\u00e7erlilik ta\u015f\u0131mamaktad\u0131r. Bunlar yarg\u0131y\u0131, \u00f6zellikle de y\u00fcksek yarg\u0131y\u0131 tan\u0131mamaktan kaynaklanan bos s\u00f6zlerdir. Yarg\u0131, kimsenin ne arka bah\u00e7esi, ne \u00f6n bah\u00e7esi, ne de yan bah\u00e7esidir. Olmam\u0131\u015ft\u0131r, olmayacakt\u0131r da. Buna, her t\u00fcrl\u00fc olanaks\u0131zl\u0131\u011fa kar\u015f\u0131n, onuru ile \u00f6zveri ile meslek sayg\u0131nl\u0131\u011f\u0131n\u0131 her \u015feyin \u00fczerinde tutarak g\u00f6rev yapan, T\u00fcrk yarg\u0131\u00e7lar\u0131, Cumhuriyet Savc\u0131lar\u0131, hi\u00e7bir zaman izin vermeyecektir.&#8221; dedi.<\/p>\n<p>&#8220;HER KURUMDA YANLI\u015e YAPANLAR OLAB\u0130L\u0130R&#8221;<\/p>\n<p>&#8220;Her kurumda oldu\u011fu gibi, olmas\u0131 hi\u00e7bir zaman istenmez ama yarg\u0131da da bireysel olarak yanl\u0131\u015f yapanlar, hatal\u0131 davrananlar olabilir.&#8221; diyen Ger\u00e7eker, \u015f\u00f6yle devam etti: &#8220;Zaman zaman kamuoyuna da yans\u0131d\u0131\u011f\u0131 gibi, yap\u0131lan usule ayk\u0131r\u0131 i\u015flemler, usuls\u00fcz ileti\u015fimin takip ve tespiti, g\u00f6zetim alt\u0131na alma, tutukluluk gibi temel hak ve \u00f6zg\u00fcrl\u00fcklerle, \u00f6zel hayat\u0131n gizlili\u011fi ve adil yarg\u0131lanma hakk\u0131 ile do\u011frudan ili\u015fkili konularda yap\u0131lan yanl\u0131\u015flar, \u00e7eli\u015fkili uygulamalar, toplum vicdan\u0131nda b\u00fcy\u00fck yaralar a\u00e7makta, yarg\u0131ya olan g\u00fcvenin sars\u0131lmas\u0131na neden olmaktad\u0131r. Be\u011fenilmese de sayg\u0131 g\u00f6sterilmesi, uygulanmas\u0131 gerekir. Ele\u015ftiri s\u0131n\u0131rlar\u0131n\u0131 asan, kurumsal su\u00e7lama niteli\u011fine varan s\u00f6ylemlerden mutlaka ka\u00e7\u0131n\u0131lmal\u0131d\u0131r. Toplumlar\u0131 g\u00fc\u00e7lendirecek, daha da ileriye ta\u015f\u0131yacak, toplumsal bar\u0131\u015f, kar\u015f\u0131l\u0131kl\u0131 anlay\u0131\u015f, sevgi, sayg\u0131 ortam\u0131 ancak bu \u015fekilde, devleti olu\u015fturan \u00fc\u00e7 ana erk in ( yasama, y\u00fcr\u00fctme, yarg\u0131 ) birbirlerinin anayasal hak, yetki ve g\u00f6revlerini i\u00e7selle\u015ftirmeleri bunlar\u0131 kabullenmeleri ile ger\u00e7ekle\u015febilir.&#8221;<\/p>\n<p>&#8220;\u0130\u00c7 TEHD\u0130T OLARAK G\u00d6STERMEK \u0130NSAFSIZ B\u0130R YAKLA\u015eIMDIR&#8221;<\/p>\n<p>Yarg\u0131tay&#8217;\u0131n b\u00fct\u00fcn \u00fcyelerinin, Dan\u0131\u015ftay \u00fcyelerinin b\u00fcy\u00fck bir k\u0131sm\u0131n\u0131n ilk derece mahkemelerinden nitelikleri g\u00f6zetilerek se\u00e7ilip geldi\u011fini anlatan Ger\u00e7eker, bunlar\u0131n mesleklerinde kendilerini kabul ettirmi\u015f, \u00f6ne \u00e7\u0131km\u0131\u015f ki\u015filer oldu\u011funu ifade etti.<\/p>\n<p>Bu \u00fcyelerin y\u00fcksek mahkemelerde, H\u00e2kimler ve Savc\u0131lar Y\u00fcksek Kurulu&#8217;nda, ilk derece mahkemelerindeki meslekta\u015flar\u0131 ad\u0131na da g\u00f6rev yapt\u0131\u011f\u0131n\u0131 dile getiren Ger\u00e7eker, &#8220;Y\u00fcksek mahkemeler yarg\u0131n\u0131n \u00f6nc\u00fc kurumlar\u0131d\u0131r. Bunu bir vesayet olarak tan\u0131mlamak, hatta bir &#8220;i\u00e7 tehdit&#8221; olarak g\u00f6stermek son derece insafs\u0131z ve yanl\u0131\u015f bir yakla\u015f\u0131md\u0131r.&#8221; diye konu\u015ftu.<\/p>\n<p>Yap\u0131lmak istenilen de\u011fi\u015fikliklerin Avrupa&#8217;daki \u00e7a\u011fda\u015f yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131 anlay\u0131\u015f\u0131na uygun oldu\u011fu d\u00fc\u015f\u00fcncesinin de do\u011fru olmad\u0131\u011f\u0131n\u0131 ileri s\u00fcren Ger\u00e7eker, bu konuda yetkin olan kurumlar\u0131n yay\u0131mlad\u0131\u011f\u0131 bir\u00e7ok belgede, tavsiye raporlar\u0131nda, ba\u011f\u0131ms\u0131z yarg\u0131 \u00f6l\u00e7\u00fcleri, y\u00fcr\u00fctmenin yarg\u0131 kurullar\u0131 \u00fczerinde etkin olmamas\u0131 do\u011frultusunda oldu\u011funu savundu.<\/p>\n<p>Birbirleri ile ilgisi olmayan konular\u0131n, ayr\u0131 ayr\u0131 referanduma sunulmas\u0131n\u0131n \u00e7a\u011fda\u015f anayasal demokrasinin ve hukukun gere\u011fi oldu\u011funun alt\u0131n\u0131 \u00e7izen Ger\u00e7eker, \u015f\u00f6yle devam etti: &#8220;Bu gereklilik de ne yaz\u0131k ki g\u00f6z ard\u0131 edilmi\u015ftir. Ne yaz\u0131k ki, nas\u0131l 12 Eyl\u00fcl Anayasas\u0131&#8217;n\u0131n yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131na ayk\u0131r\u0131 h\u00fck\u00fcmleri bug\u00fcne kadar hep ele\u015ftiri konusu edilmi\u015f ise, simdi yap\u0131lan de\u011fi\u015fikliklerle bu ele\u015ftiriler daha da yo\u011funla\u015fm\u0131\u015f bi\u00e7imde s\u00fcrmeye devam edecektir. \u00d6zellikle, y\u00fcksek mahkemeler ile y\u00fcr\u00fctme aras\u0131nda, uzla\u015fmazl\u0131k daha da artarak geni\u015fleyecektir.
