Asker\u00ee okullardan ve TSK&#8217;dan her ne sebeple olursa olsun ili\u015fikleri kesilen personel s\u00f6zle\u015fmeli er olarak al\u0131nmayacak.<\/p>\n<p>S\u00f6zle\u015fmeli er adaylar\u0131, \u00f6n s\u00f6zle\u015fme yap\u0131larak asker\u00ee e\u011fitime al\u0131nacak. Asker\u00ee e\u011fitimi ba\u015far\u0131 ile tamamlayanlarla, 4 y\u0131ldan fazla olmamak kayd\u0131yla en az \u00fc\u00e7 y\u0131ll\u0131k s\u00f6zle\u015fme yap\u0131lacak. M\u00fcteakip s\u00f6zle\u015fmeler, bir y\u0131ldan az \u00fc\u00e7 y\u0131ldan fazla olmamak \u015fart\u0131yla azam\u00ee 29 ya\u015f\u0131n bitirildi\u011fi y\u0131l\u0131n aral\u0131k ay\u0131 sonuna kadar uzat\u0131labilecek.<\/p>\n<p>S\u0131k\u0131y\u00f6netim, seferberlik, sava\u015f veya ter\u00f6rle m\u00fccadeleden kaynaklanan zorunlu h\u00e2llerde ise ihtiya\u00e7 duyulanlar\u0131n s\u00f6zle\u015fme s\u00fcreleri, talebe ve ya\u015f haddine bak\u0131lmaks\u0131z\u0131n kuvvet komutanlar\u0131, Jandarma Genel Komutan\u0131 veya Sahil G\u00fcvenlik Komutan\u0131&#8217;n\u0131n istemi \u00fczerine ve durumun devam\u0131 m\u00fcddetince, Genelkurmay Ba\u015fkan\u0131&#8217;n\u0131n onay\u0131 ile uzat\u0131labilecek.<\/p>\n<p>S\u00f6zle\u015fmeli erlikte en az iki y\u0131l\u0131n\u0131 tamamlayanlar, kadro g\u00f6rev yeri uygunsa liyakat durumu da dikkate al\u0131narak y\u00f6netmelikte belirtilen esaslar d\u00e2hilinde s\u00f6zle\u015fmeli onba\u015f\u0131l\u0131\u011fa; s\u00f6zle\u015fmeli onba\u015f\u0131l\u0131kta en az iki y\u0131l\u0131n\u0131 tamamlayanlar, kadro g\u00f6rev yeri uygunsa liyakat durumu da dikkate al\u0131narak y\u00f6netmelikte belirtilen esaslar d\u00e2hilinde s\u00f6zle\u015fmeli \u00e7avu\u015flu\u011fa ge\u00e7irilecek.<\/p>\n<p>Y\u00fcksek Askeri \u015eura (YA\u015e) kararlar\u0131 veya yarg\u0131 denetimine kapal\u0131 i\u015flemlerle T\u00fcrk Silahl\u0131 Kuvvetlerden (TSK) ili\u015fi\u011fi kesilenlere emeklilik ya da kamuda istihdam olana\u011f\u0131 getiren kanuna g\u00f6re, ili\u015fi\u011fi kesilenlere emsali r\u00fctbelerdekilere denk \u00f6zl\u00fck haklar\u0131 \u00fczerinden emeklilik imk\u00e2n\u0131 sa\u011flan\u0131yor.<\/p>\n<p>Yasan\u0131n y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten \u00f6nce YA\u015e kararlar\u0131yla TSK&#8217;dan ili\u015fi\u011fi kesilenlerin veya bunlar\u0131n vefat\u0131 halinde hak sahiplerinin getirilen d\u00fczenlemeden yararlanmas\u0131 i\u00e7in 60 g\u00fcn i\u00e7inde Milli Savunma Bakanl\u0131\u011f\u0131&#8217;na ba\u015fvurmas\u0131 gerekiyor.<br \/>\nBakanl\u0131k, en ge\u00e7 alt\u0131 ay i\u00e7inde ba\u015fvurunun ret veya kabul\u00fcne karar verecek. TSK&#8217;dan ili\u015fikleri kesilenlerin, bu tarihten d\u00fczenlemenin y\u00fcr\u00fcrl\u00fck tarihine kadar ge\u00e7en s\u00fcreleri TSK&#8217;da ge\u00e7mi\u015f kabul edilecek. Bu ki\u015filerin TSK&#8217;dan ili\u015fiklerinin kesildi\u011fi tarih ile d\u00fczenlemenin y\u00fcr\u00fcrl\u00fck tarihi aras\u0131ndaki d\u00f6neme ili\u015fkin yat\u0131r\u0131lmam\u0131\u015f sigorta prim ve emekli kesene\u011fi, kurumlar\u0131nca \u00f6denecek.<\/p>\n<p>Bu haktan yararlanacaklar, emeklili\u011fe ili\u015fkin sosyal ve \u00f6zl\u00fck haklar\u0131 bak\u0131m\u0131ndan emsali subay ve astsubaylarla e\u015fitlenecek. Getirilen d\u00fczenlemeye hak kazananlardan emekli olanlar\u0131n kendilerine, hayatta de\u011filse kanuni miras\u00e7\u0131lar\u0131na, emsallerinin emekli oldu\u011fu tarihteki \u00f6zl\u00fck haklar\u0131 \u00fczerinden emeklilik veya dul ve yetim ayl\u0131\u011f\u0131 ba\u011flanacak, ikramiye \u00f6denecek.
