Zorunlu askerli\u011fi yapmam\u0131\u015f olanlar i\u00e7in verilen ceza s\u00f6zle\u015fmeye ayk\u0131r\u0131 bulunmuyor.&#8221; diyen Ergin, &#8220;Bu cezan\u0131n bir \u00f6m\u00fcr boyu tesels\u00fcl ettirilmesi orant\u0131s\u0131z olarak bulundu\u011fu i\u00e7in T\u00fcrkiye ihlale konu karar\u0131n muhatab\u0131 olmu\u015ftur&#8221; dedi.<\/p>\n<p>A\u0130HM\u2019in T\u00fcrkiye aleyhine verdi\u011fi karar\u0131 tahlil etmek gerekti\u011fini vurgulayan Ergin, \u015f\u00f6yle devam etti: &#8220;O kararda T\u00fcrkiye\u2019nin yanl\u0131\u015f bulunan uygulamas\u0131 \u00fczerinde \u00e7al\u0131\u015fmak laz\u0131md\u0131. \u015euanda 2007 y\u0131l\u0131ndan beri Savunma Bakanl\u0131\u011f\u0131\u2019n\u0131n \u00fczerinde durdu\u011fu konu budur. Konunun do\u011fru zeminde tart\u0131\u015f\u0131lmas\u0131 gerekir. Zorunlu askerlik tart\u0131\u015fma konusu de\u011fildir. Cezan\u0131n tesels\u00fcl ettirilerek bir ki\u015finin \u00f6mr\u00fcn\u00fcn sonuna kadar b\u00f6yle bir tehdit alt\u0131nda kalmas\u0131 s\u00f6zle\u015fmeye ayk\u0131r\u0131 bulunmu\u015ftur. Dolay\u0131s\u0131yla tart\u0131\u015fman\u0131n bu \u00e7er\u00e7evede olmas\u0131 do\u011fru olacakt\u0131r.
