Indian Supreme Court Monday asked Italy’s envoy to India Daniele Mancini not to leave India till April 2, when the case about killing of two fishermen by Indian marines will be heard again.

New Delhi, March 18/Nationalturk – The diplomatic row between India and Ital over denial by Italy government to send two of its marines to face trial for shooting two fishermen in India continues with Indian Supreme Court Monday asking the Italy’s envoy to India Daniele Mancini not to leave the country till April 2, when the case will be heard again.

The Supreme Court today heard the case regarding denial by Italy’s government to send two of its marines to face trial in India for killing two fishermen in Indian waters.

“We don’t trust Italy’s envoy to India Daniele Mancini anymore. We did not expect him to behave like this,” said the supreme court judges.

They were referring assurances that had been given in writing by Italy’s envoy to the apex court that if the marines were allowed to go to home (Italy) in February to case votes in general election, they would return in a month to face murder charges in India.

‘A person who gives undertaking has no immunity’

Taking a dig at Mancini for telling that had enjoys complete immunity under the Vienna Convention, the Apex Court said, “A person who comes to the court and gives undertaking has no immunity.”

As per Article 29 of the Vienna Convention on Diplomatic Relations, 1961, the diplomats shall “not be liable to any form of arrest or detention”.

The Court also restrained him (Mancini) from leaving India till April 2, when the case would be heard again.

“All authorities shall take appropriate steps to restrain Italian envoy from leaving the country,” the Apex court said.

It had on March 15 asked Italian Ambassador to India not to leave the from country without its permission and consent after taking strong exception to Italy government’s refusal to send back the marines.

Earlier, on March 11 Italian government had told Indian government that it won’t be sending the two marines back to India to face trial.

The two marines — Massimiliano Lattore and Salvatore Girone — were allowed by Indian Supreme Court to go to Italy to cast their vote in the elections there after the Italian Ambassador had given an assurance to send them back. Indian government, according to sources, is mulling various options including declaring the Italian Ambassador as persona non-grata and downgrading of relations.

According to Indian government the two Italian marines were on board Italian vessel ‘Enrica Lexie’, when they shot dead two fishermen on the Indian waters on February 15, last year. However, Italy’s government says the incident did not took place in Indian waters.
